Accept
A ZONE
Areas subject to inundation by the one-percent-annual-chance flood event generally determined using approximate methodologies. Because detailed hydraulic analyses have not been performed, no base flood elevations (BFEs) or flood depths are shown. Mandatory flood insurance purchase requirements and floodplain management standards apply.
ABANDONED SIGN
A sign not used for its original intent or a sign on a vacant, unoccupied or abandoned property.
ACCESSORY BUILDING, STRUCTURE OR USE
A building, structure or use which:

A. Is subordinate to and serves a principal building or a principal use (including, but not limited to, the production, harvesting, storage, washing, grading and/or packaging of unprocessed produce grown on-site);

B. Is subordinate in area, extent and purpose to the principal structure or principal building and/or principal use served;

C. Contributes primarily to the comfort, convenience or necessity of the occupants, business or industry of the principal structure or principal use served; and

D. Is located on the same lot as the principal structure or principal use served, except as otherwise expressly authorized by the provisions of this ordinance and the Pinelands Comprehensive Management Plan.
ACT
The Fair Housing Act of 1985, P.L. 1985, c. 222 (N.J.S.A. 52:27D-301 et seq.).
ACT or SWMA
The Solid Waste Management Act, N.J.S.A. 13:1E-1 et seq., as amended and supplemented.
ADAPTABLE
Constructed in compliance with the technical design standards of the Barrier Free Subcode, N.J.A.C. 5:23-7.
ADAPTIVE REUSE
The conversion of an existing building or structure to a new use, while preserving the existing architecture to the greatest extent possible.
ADDITION
The construction of a new improvement as a part of an existing structure when such new improvement changes the exterior appearance of any structure.
ADMINISTRATIVE AGENT
The entity responsible for the administration of affordable units in accordance with this section, N.J.A.C. 5:91, N.J.A.C. 5:93 and UHAC (N.J.A.C. 5:80-26).
ADMINISTRATIVE OFFICER
The Secretary of the Planning Board or the Secretary of the Zoning Board of Adjustment, whichever the case may be, of the Township of Medford, Burlington County, New Jersey, unless a different municipal official is designated by this ordinance to administer certain of the responsibilities and authorities specified for the Administrative Officer in N.J.S.A. 40:55D-1 et seq.
ADVERSE EFFECT
Conditions or situations created by a proposed development that impose, aggravate or lead to impractical, unsafe or unsatisfactory conditions on surrounding properties including, but not limited to, inadequate drainage facilities, inadequate public utilities, unsuitable street grades, street locations that fail to compose a convenient system, and failure to provide or make future allowance for access to the interior portion of adjoining lots or for other facilities required by this ordinance.
AE ZONE
Areas subject to inundation by the one-percent-annual-chance flood event determined by detailed methods. Base flood elevations (BFEs) are shown. Mandatory flood insurance purchase requirements and floodplain management standards apply.
AFFIRMATIVE MARKETING
A regional marketing strategy designed to attract buyers and/or renters of affordable units pursuant to N.J.A.C. 5:80-26.15.
AFFORDABILITY AVERAGE
The average percentage of median income at which restricted units in an affordable housing development are affordable to low- and moderate-income households.
AFFORDABLE
A sales price or rent level that is within the means of a low- or moderate-income household as defined in N.J.A.C. 5:93-7.4 and, in the case of an ownership unit, that the sales price for the unit conforms to the standards set forth in N.J.A.C. 5:80-26.6, as may be amended and supplemented, and, in the case of a rental unit, that the rent for the unit conforms to the standards set forth in N.J.A.C. 5:80-26.12, as may be amended and supplemented.
AFFORDABLE DEVELOPMENT
A housing development of which all or a portion consists of housing affordable to low- and moderate-income households.
AFFORDABLE HOUSING DEVELOPMENT
A development included in the Housing Element and Fair Share Plan, and includes, but is not limited to, an inclusionary development, a municipal construction project or a 100% affordable housing development.
AFFORDABLE HOUSING DEVELOPMENT
A development included in the Housing Element and Fair Share Plan, and includes, but is not limited to, an inclusionary development, a municipal construction project or a 100% affordable development.
AFFORDABLE HOUSING PROGRAM(S)
Any mechanism in a municipal Fair Share Plan prepared or implemented to address a municipality's fair share obligation.
AFFORDABLE UNIT
A housing unit proposed or created pursuant to the Act, credited pursuant to N.J.A.C. 5:93, and/or funded through an affordable housing trust fund.
AGENCY
The New Jersey Housing and Mortgage Finance Agency established by P.L. 1983, c. 530 (N.J.S.A. 55:14K-1 et seq.).
AGE-RESTRICTED UNIT
A housing unit designed to meet the needs of, and exclusively for, the residents of an age-restricted segment of the population such that:

1. All the residents of the development where the unit is situated are 62 years of age or older; or

2. At least 80% of the units are occupied by one person that is 55 years of age or older; or

3. The development has been designated by the Secretary of the U.S. Department of Housing and Urban Development as "housing for older persons" as defined in Section 807(b)(2) of the Fair Housing Act, 42 U.S.C. § 3607.
AGRICULTURAL COMMERCIAL ESTABLISHMENT
A retail sales establishment primarily intended to sell agricultural products produced in the Pinelands Area. An agricultural commercial establishment may be seasonal or year-round, and may or may not be associated directly with an Agricultural/Horticultural Use; however, it does not include supermarkets, convenience stores, restaurants and other establishments which coincidentally sell agricultural products, nor does it include agricultural production facilities such as an Agricultural/Horticultural Use itself, nor does it include facilities which are solely processing facilities.
AGRICULTURAL/HORTICULTURAL PRODUCTS PROCESSING FACILITY
A facility designed, constructed and operated for the express purpose of processing agricultural/horticultural products grown in the Pinelands Area, including the washing, grading and packaging of those products.
AGRICULTURE/HORTICULTURE EMPLOYEE HOUSING
Residential dwellings for the seasonal use of employees of an Agricultural/Horticultural Use which, because of their character or location, are not to be used for permanent housekeeping units and which are otherwise accessory to a principal use of the lot for agriculture or horticulture.
AGRICULTURE/HORTICULTURE USES
PRINCIPAL USES — Any production of plants or animals useful to man including, but not limited to: forages or sod crops; grains and feed crops; dairy animals and dairy products; poultry and poultry products; livestock, including beef cattle, sheep, swine, horses, ponies, mules or goats and including the breeding and grazing of any or all such animals; bees and apiary products; fur animals; trees and forest products; fruits of all kinds, including grapes, nuts and berries; vegetables; nursery, floral, ornamental and greenhouse products; or any land devoted to and meeting the requirements and qualifications for payments or other compensation pursuant to a soil conservation program under an agency of the federal government.

ACCESSORY USES — Any structure, excluding residential dwellings, used for storing agricultural equipment or farm produce, housing livestock or poultry or processing dairy products.
AH ZONE
Areas subject to inundation by one-percent-annual-chance shallow flooding (usually areas of ponding) where average depths are between one foot and three feet. Base flood elevations (BFEs) derived from detailed hydraulic analyses are shown in this zone. Mandatory flood insurance purchase requirements and floodplain management standards apply.
A-HORIZON
The uppermost mineral horizon in a normal soil profile. The upper part of the A-horizon is characterized by maximum accumulation of finely divided, dark-colored, organic residues, known as "humus," which are intimately mixed with the mineral particles of the soil.
AIRPORT <div style="margin-left:40px">Any area of land or water, or both, designed and set aside for the landing and taking-off of fixed wing aircraft, utilized or to be utilized by the general public for such purposes, publicly or privately owned, and licensed by the Commissioner of the Department of Transportation as a public use airport or landing strip.</div>
AIRPORT HAZARD
Any use of land or water, or both, which may create a dangerous condition for persons or property in or about an airport or aircraft during landing or taking-off at an airport; or, any structure or tree which obstructs the airspace required for the flight of aircraft in landing or taking-off at an airport.
AIRPORT HAZARD AREA
An Airport Hazard Area shall be established for each runway at an airport and shall consist of a Runway Subzone, two Runway End Subzones and two Clear Zones. The overall Airport Hazard Area for an airport is geometrically constructed by defining and locating the Runway Subzone and Runway End Subzones for each runway open to the public on an airport open to the public. The outermost borders of the subzones comprise the outermost boundary of the Airport Hazard Area. The area within those outermost boundaries is that area regulated by the provisions of this ordinance and is the Airport Hazard Area for an airport.
ALTERATION
Any work done on any improvement(s) which:
1. Is not an addition to that improvement; and
2. Changes the appearance of the exterior surface of any improvement.
ALTERATIONS, OR ADDITIONS, STRUCTURAL
Any change in either the supporting members of a building such as bearing walls, columns, beams and girders, or in the dimensions or configuration of the roof or exterior walls.
ALTERNATE DESIGN PILOT PROGRAM TREATMENT SYSTEM
An individual or community on-site wastewater treatment system that has the capability of providing a high level of treatment including a significant reduction in the level of total nitrogen in the wastewater and that has been approved by the Pinelands Commission for participation in the alternate design wastewater treatment systems pilot program pursuant to N.J.A.C. 7:50-10.23(b). Detailed plans and specifications for each authorized technology are available at the principal office of the Pinelands Commission.
ALTERNATIVE LIVING ARRANGEMENT
A structure in which households live in distinct bedrooms, yet share kitchen and plumbing facilities, central heat and common areas. "Alternative living arrangement" includes, but is not limited to, transitional facilities for the homeless, Class A, B, C, D, and E boarding homes as regulated by the New Jersey Department of Community Affairs; residential health care facilities as regulated by the New Jersey Department of Health; group homes for the developmentally disabled and mentally ill as licensed and/or regulated by the New Jersey Department of Human Services; and congregate living arrangements.
AMATEUR RADIO ANTENNA
The arrangement of wires or metal rods used in the sending and receiving of electromagnetic waves.
AMATEUR RADIO ANTENNA SUPPORT STRUCTURE
Any structure, mast, pole, tripod or tower utilized for the purpose of supporting an antenna or antennas for the purpose of transmission or reception of electromagnetic waves (by federally licensed amateur radio operators).
AMATEUR RADIO STATION
A radio station operated in the amateur radio service under license by the Federal Communication Commission.
ANIMALS, THREATENED OR ENDANGERED
Those animals designated by the Department of Environmental Protection and Energy pursuant to N.J.S.A. 23-2A-1 et seq.
AO ZONE
Areas subject to inundation by one-percent-annual-chance shallow flooding (usually sheet flow on sloping terrain) where average depths are between one foot and three feet. Average flood depths derived from detailed hydraulic analyses are shown in this zone. Mandatory flood insurance purchase requirements and floodplain management standards apply.
APPEAL
A request for a review of the Floodplain Administrator's interpretation of any provision of this section or a request for a variance.
APPLICANT OR OWNER
The legal or beneficial owner or owners of a lot or of any land to be proposed to be included in a proposed development including the holder of an option or contract to purchase, or other person having an enforceable proprietary interest in such land.
APPLICATION FOR DEVELOPMENT/MUNICIPAL LAND USE LAW
The application or appeal forms and all accompanying documents required by this ordinance for approval of a subdivision plat, site plan, planned development, conditional use, zoning variance or direction for issuance of a permit pursuant to N.J.S.A. 40:55D-34 or N.J.S.A. 40:55D-36.
APPLICATION FOR DEVELOPMENT/PINELANDS
Any application filed with the Township of Medford for any approval, authorization or permit which is a prerequisite to initiating development in the Pinelands Area, except as provided in § 802.E of this ordinance.
AQUACULTURE
The propagation, rearing and subsequent harvesting of aquatic organisms in controlled or selected environments, and their subsequent processing, packaging and marketing, including, but not limited to, activities to intervene in the rearing process to increase production, such as stocking, feeding, transplanting and providing for protection from predators.
AREA OF SHALLOW FLOODING
A designated AO or AH Zone on a community's Digital Flood Insurance Rate Map (DFIRM) with a one-percent-annual or greater chance of flooding to an average depth of one foot to three feet where a clearly defined channel does not exist, where the path of flooding is unpredictable and where velocity flow may be evident. Such flooding is characterized by ponding or sheet flow.
AREA OF SPECIAL FLOOD HAZARD
Land in the floodplain within a community subject to a 1% or greater chance of flooding in any given year. It is shown on the FIRM as Zone A, AO, A1-A30, AE, A99, or AH.
ARTESIAN ZONE OF SATURATION
A zone of saturation which exists immediately below a hydraulically restrictive horizon and which has an upper surface that is at a pressure greater than atmospheric, either seasonally or throughout the year.
ARTIFICIAL REGENERATION
The establishment of tree cover through direct or supplemental seeding or planting.
ASSISTED LIVING FACILITY
A facility licensed by the New Jersey State Department of Health and Senior Services pursuant to N.J.A.C. 8:36 which is designed and operated to provide apartment style housing and congregate dining while assuring that a coordinated array of supportive personal and health services are available, as needed to four or more adult persons unrelated to the proprietor.
ASSISTED LIVING RESIDENCE
A facility that is licensed by the New Jersey Department of Health and Senior Services to provide apartment-style housing and congregate dining and to assure that assisted living services are available when needed for four or more adult persons unrelated to the proprietor and that offers units containing, at a minimum, one unfurnished room, a private bathroom, a kitchenette and a lockable door on the unit entrance.
ASSISTED LIVING UNIT
A unit in an Assisted Living Facility that shall offer, at a minimum, one unfurnished room, a private bathroom, a kitchenette and a lockable door on the unit entrance. Each unit with a lockable door shall be a dwelling for the purposes of calculating gross density.
AUTOMOBILE SALES
The use of any building, land area or other premises for the display and sale of new or used automobiles, panel trucks or vans, trailers, or recreation vehicles, and including any warranty repair work and other repair service conducted as an accessory use.
AWNING
A temporary or portable roof-like covering that projects from and is supported by the wall of a building for the purpose of shielding openings, such as windows and doors, from the elements.
BANNER OR PENNANT SIGN
A sign intended to be hung either with or without frames, possessing characters, letters, illustrations, or ornamentation applied to paper, plastic, or fabric of any kind. National flags, flags of political subdivisions, and symbolic flags not conveying a commercial message shall not be considered pennant signs or banners for the purpose of this section.
BARN
Any building accessory to a primary residence used for the housing, storage or preparation for marketing of plants or animals, provided that a "barn" is permitted only where the use of the plants or animals to be housed, stored or prepared for marketing is an otherwise permitted use in accordance with the provisions of this ordinance.
BASE FLOOD
A flood having a 1% chance of being equaled or exceeded in any given year.
BASE FLOOD ELEVATION (BFE)
The flood elevation shown on a published Flood Insurance Study (FIS) including the Flood Insurance Rate Map (FIRM). For Zones AE, AH, AO, and A1-30, the elevation represents the water surface elevation resulting from a flood that has a 1% or greater chance of being equaled or exceeded in any given year.
BASEMENT
Any area of the building having its floor subgrade (below ground level) on all sides.
BASEMENT
That portion of a building partly below and partly above grade, where the ceiling averages four feet or more than four feet above the finished grade where such grade meets the outside walls of the building. A basement shall be considered a "story" above grade when the distance from grade to the finished surface of the floor above the basement is more than six feet for more than 50% of the total perimeter or more than 12 feet at any point.
BEACON LIGHTS
A light, consisting of one or more beams, which is capable of being directed in any direction or directions or revolved automatically.
BEDDING
A silvicultural practice involving the preparation of land before planting in the form of small mounds so as to concentrate topsoil and elevate the root zone of seedlings above temporary standing water.
BILLBOARD
Any structure or portion thereof on which lettered or pictorial matter is displayed for advertising purposes, which structure is located on a site other than the site to which the advertising relates.
BREAKAWAY WALL
A wall that is not part of the structural support of the building and is intended through its design and construction to collapse under specific lateral loading forces without causing damage to the elevated portion of the building or supporting foundation system.
BROADCAST SCARIFICATION
A silvicultural practice involving the dragging of cut trees or other objects across a parcel to remove or reduce aboveground shrub cover, debris, leaf litter and humus without disturbance to mineral soil horizons and associated roots.
BUILDING
A combination of materials to form a construction adapted to permanent, temporary or continuous occupancy and having a roof.
BUILDING HEIGHT
The vertical distance measured from the mean elevation of the finished grade five feet from the foundation along the side(s) of the building facing a street and measured to the highest point. In all cases where this ordinance provides for height limitations by reference to a specified height and a specified number of stories, the intent is to limit height to the specified maximum footage and the specified number of stories within said footage.
BUILDING RESTRICTION LINE
A line that is a specified distance from the centerline of a runway; between this line and the runway, there may be no buildings, structures, trees or other such permanent or semipermanent obstructions.
BURLINGTON COUNTY REGIONAL PROGRAM
The program utilized for the collection of those recyclable materials as designated by the Department of Solid Waste from residential curbside, participating multifamily and participating school collection programs.
CAFRA CENTERS, CORES OR NODES
Those areas with boundaries incorporated by reference or revised by the Department in accordance with N.J.A.C. 7:7-13.16.
CAFRA PLANNING MAP
The map used by the Department to identify the location of Coastal Planning Areas, CAFRA Centers, CAFRA Cores, and CAFRA Nodes. The CAFRA Planning Map is available on the Department's Geographic Information System (GIS).
CAMPER
A portable structure, which is self propelled or mounted on or towed by another vehicle, and which is designed and used for temporary living for travel, recreation, vacation or other short-term uses. Camper does not include mobile homes or other dwellings.
CAMPSITE
A place used or suitable for camping, on which temporary shelter such as a tent or camper may be placed and occupied on a temporary and seasonal basis.
CANOPY, ATTACHED
An architectural projection supported by or attached to a building, which may be supported by columns or piers.
CANOPY, FREESTANDING
A multisided overhead structure supported by columns but not enclosed by walls.
CARPORT
A roofed structure providing space for the parking or storage of motor vehicles and enclosed on not more than three sides.
CARTWAY
The hard or paved surface portion of a street customarily used for vehicles in the regular course of travel. Where there are curbs, the cartway is that portion between the curbs. Where there are no curbs, the cartway is that portion between the edges of the paved or graded width.
CELLAR
That portion of a building partly or wholly below grade, where the ceiling averages less than four feet above the finished grade where such grade meets the outside walls of the building.
CEMETERY
A cemetery shall be that which is defined as such under the provisions of the New Jersey Cemetery Act, 2003, N.J.S.A. 45:27-1, et seq., and the regulations adopted pursuant to this legislation, or any successor, or replacement law.
CERTIFICATE OF APPROPRIATENESS
A document that is recommended by the Historic Preservation Commission and issued by the Planning Board, Zoning Board of Adjustment or Historic Preservation Commission, following a prescribed series of hearings and review procedures, certifying that the proposed development is found to be acceptable in terms of design criteria relating to an Historic District as an entity, or to an individual site, structure or building within an Historic District.
CERTIFICATE OF FILING
A certificate issued by the Pinelands Commission pursuant to N.J.A.C. 7:50-4.34 and 4.82 that a complete application for major development has been filed.
CERTIFICATION
A written statement signed and sealed by a licensed New Jersey professional engineer attesting that a BMP design or stormwater management system conforms to or meets a particular set of standards or to action taken by the Commission pursuant to N.J.A.C. 7:50-3, Part II or Part IV. Depending upon the context in which the term is use, the terms "certify" and "certified" shall be construed accordingly.
CERTIFIED HOUSEHOLD
A household that has been certified by an Administrative Agent as a low-income household or moderate-income household.
CHANNEL
A linear topographic depression that continuously or intermittently confines and/or conducts surface water, not including transient erosional gullies and other ephemeral features that temporarily form after heavy rainfall. A channel can be naturally occurring or can be of human origin through excavation or construction, in which case it is referred to as "man-made." A channel includes both bed and banks.
CHROMA
The relative purity or strength of a color, a quantity which decreases with increasing grayness. Chroma is one of the three variables of soil color as defined in the Munsell system of classification.
CLASS A RECYCLABLE MATERIAL
Source-separated, nonputrescible, metal, glass, paper and plastic containers; and corrugated and other cardboard.
CLAY
A particle size category consisting of mineral particles which are smaller than 0.002 millimeter in equivalent spherical diameter; also, a soil textural class having more than 40% clay, less than 45% sand, and less than 40% silt, as shown in Subsection K.3.a (USDA Soil Textural Triangle).
CLAY LOAM
A soil textural class having 27% to 40% clay and 20% to 45% sand, as shown in Subsection K.3.a (USDA Soil Textural Triangle).
CLEAR ZONES
The Clear Zones of an Airport Hazard Area shall consist of trapezoids located within the Runway End Subzone along the flight approach and departure path. Each Clear Zone shall extend 1,000 feet from the end of the Runway Subzone, as measured along the extended centerline of the Runway. The base of the Clear Zone shall be co-located with the end of the Runway Subzone, and shall have a width of 250 feet. The width of the Clear Zone shall increase as the distance from the end of the Runway Safety Zone increases. Its final width shall be 400 feet.
CLEARCUTTING
A silvicultural practice involving removal of an entire forest stand in one cutting for purposes of regeneration, either obtained artificially, by natural seed or from advanced regeneration. Clearcutting typically results in the removal of all woody vegetation from a parcel in preparation for the establishment of new trees; however, some trees may be left on the parcel.
CLEARING
Dictionary definition - tract of land cleared of wood and brush. Brush - scrub vegetation.
COAH
The Council on Affordable Housing, which is in, but not of, the Department of Community Affairs of the State of New Jersey, as established by the New Jersey Fair Housing Act (N.J.S.A. 52:27D-301 et seq.).
COAH or the COUNCIL
The New Jersey Council on Affordable Housing established under the Fair Housing ActEditor's Note: See N.J.S.A. 52:27D-301 et seq. which previously had primary jurisdiction for the administration of housing obligations in accordance with sound regional planning consideration in the state.
COARSE FRAGMENT
A rock fragment contained within the soil which is greater than two millimeters in equivalent spherical diameter or which is retained on a two-millimeter sieve.
COMBINATION OFFICE, SERVICE, AND/OR RETAIL SALES
Office, service and retail uses as described in the respective zone, in any combination, subject to controls including specified and limited overnight parking of service or delivery vehicles or trucks parked in assigned spaces obscured from public view, and limited outdoor storage of materials. These uses are not to include contractor's office and yard operations involving the parking/storage of trucks and heavy equipment and construction materials as found with general, electrical and plumbing contractors, for example.
COMMENCEMENT OF CONSTRUCTION
Actual construction on a parcel of land in accordance with a permit issued by the applicable jurisdiction.
COMMINGLED
A combining of source-separated recyclable materials for the purpose of recycling.
COMMISSION
The Pinelands Commission created pursuant to N.J.S.A. 13:18A-5 of the Pinelands Protection Act.
COMMON AREA RECYCLING STORAGE LOCATION
A location designed in accordance with the land use ordinances of this municipality as required for multifamily dwellings with more than 20 residential units where curbside collection is not provided under the Burlington County Regional Program.
COMMON OPEN SPACE
An open space area within or related to a site designated as a development, and designed and intended for the use or enjoyment of residents and owners of the development. Common open space may contain such complimentary structures and improvements as are necessary and appropriate for the use or enjoyment of residents and owners of the development.
COMMUNITY BASIN
An infiltration system, sand filter designed to infiltrate, standard constructed wetland, or wet pond, established in accordance with N.J.A.C. 7:8-4.2(c)14, that is designed and constructed in accordance with the New Jersey Stormwater Best Management Practices Manual, or an alternate design, approved in accordance with N.J.A.C. 7:8-5.2(g), for an infiltration system, sand filter designed to infiltrate, standard constructed wetland, or wet pond and that complies with the requirements of this chapter.
COMMUNITY RESIDENCE FOR PERSONS WITH HEAD INJURIES
Any community resident facility licensed pursuant to P.L. 1977, c.448 (N.J.S.A. 30:11B-1 et seq.) providing food, shelter and personal guidance, under such supervision as required, to not more than 15 persons with head injuries, who require assistance, temporarily or permanently, in order to live in the community, and shall include, but not be limited to: group homes, halfway houses, supervised apartment living arrangements, and hostels. Such a residence shall not be considered a health care facility within the meaning of the Health Care Facilities Planning Act, P.L. 1971, c. 136 (N.J.S.A. 26:2H-1 et seq.).
COMMUNITY RESIDENCE FOR THE DEVELOPMENTALLY DISABLED
Any community residential facility licensed pursuant to P.L. 1977, c.448 (N.J.S.A. 30:11B-1 et seq.) providing food, shelter and personal guidance, under such supervision as required, to not more than 15 developmentally disabled or mentally ill persons, who require assistance, temporarily or permanently, in order to live in the community, and shall include, but not be limited to: group homes, half-way houses, intermediate care facilities, supervised apartment living arrangements, and hostels. Such a residence shall not be considered a health care facility, within the meaning of the "Health Care Facilities Planning Act," P.L. 1971, c.136 (N.J.S.A. 26:2H-1 et seq.). In the case of a community residence housing mentally ill persons, such residence shall have been approved for a purchase of service contract or an affiliate agreement pursuant to such procedures as shall be established by regulation of the Division of Mental Health and Hospitals of the Department of Human Services. "Developmentally Disabled Person" means a person who is developmentally disabled as defined in § 2 of P.L. 1971, c.136 (N.J.S.A. 26:2H-1 et seq.). In the case of a community residence housing mentally ill persons, such residence shall have been approved for a purchase of service contract or an affiliate agreement pursuant to such procedures as shall be established by regulation of the Division of Mental Health and Hospitals of the Department of Human Services. "Developmentally Disabled Person" means a person who is developmentally disabled as defined in § 2 of P.L. 1977, c.488 (N.J.S.A. 30:11B-2). "Mentally Ill Person" means a person who is afflicted with a mental illness as defined in N.J.S.A. 30:4-23, but shall not include a person who has been committed after having been found guilty of a criminal offense by reason of insanity or having been found unfit to be tried on a criminal charge.
COMMUNITY RESIDENCE FOR THE TERMINALLY ILL
Any community resident facility operated as a hospice program providing food, shelter, personal guidance and health care services, under such supervision as required, to not more than 15 terminally ill persons.
COMMUNITY SHELTER FOR VICTIMS OF DOMESTIC VIOLENCE
Any shelter approved for a purchase of a service contract and certified pursuant to standards and procedures established by regulation of the Department of Human Services pursuant to P.L. 1979, c.337 (N.J.S.A. 30:40-1-14) providing food, shelter, medical care, legal assistance, personal guidance, and other services to not more than 15 persons who have been victims of domestic violence, including any children of such victims, who temporarily require shelter and assistance in order to protect their physical or psychological welfare.
COMPACTION
The increase in soil bulk density caused by subjecting soil to greater-than-normal loading. Compaction can also decrease soil infiltration and permeability rates.
COMPACTION

COMPLETE APPLICATION
An application form completed as specified by this ordinance and the rules and regulations of the Township of Medford and all accompanying documents required by this ordinance for approval of the particular application for development as specified in § 800 of this ordinance; provided that the municipal agency may require such additional information not specified in this ordinance or revisions to the accompanying documents as are reasonably necessary to make an informed decision as to whether the requirements necessary for approval of the application for development have been met. The application shall not be deemed incomplete for lack of such additional information or any revisions to the accompanying documents so required by the municipal agency.
COMPREHENSIVE MANAGEMENT PLAN
The plan adopted by the Commission pursuant to N.J.S.A. 13:18A-8 of the Pinelands Protection Act, as amended, and known herein as "Pinelands CMP."
CONDITIONAL USE
A use permitted in a particular zoning district only upon showing that such use in a specified location will comply with the conditions and standards for the location or operation of such use as specified in this ordinance.
CONDOMINIUM COMPLEX
A group of units, arranged horizontally or vertically, where the form of ownership of real property under a master deed providing for ownership by one or more owners of units of improvements together with an undivided interest in common elements appurtenant to each such unit.
CONSTRUCTION
The construction, erection, reconstruction, alteration, conversion, demolition, removal or equipping of buildings or structures.
CONSTRUCTION OFFICIAL
An individual designated by the Township of Medford and duly licensed by the New Jersey State Department of Community Affairs to serve as the "Construction Official."
CONTIGUOUS LAND
Land which is connected or adjacent to other land so as to permit the land to be used as a functional unit, provided that separation by lot lines, streams, dedicated public roads which are not paved, rights-of-way and easements shall not affect the contiguity of land unless a substantial physical barrier is created which prevents the land from being used as a functional unit. The definition of "Contiguous Land" contained herein shall not be interpreted or applied in any manner inconsistent with the Honorable Harold B. Wells, III, A.J.S.C.'s opinion of June 29, 1989 only insofar as that opinion directs the reformation of Sewer Permit Applications Numbers 2326, 2327, 2328 and 2329.
CONTINUING CARE
The provision of lodging and nursing, medical or health related services at the continuing care retirement community or other location to an individual or for a period greater than one year, and, in consideration of the payment of an entrance fee, with or without other periodic charges, provided that the person receiving the care is not related to the person who provides the care.
CONTINUING CARE RETIREMENT COMMUNITY
A development of residential living units exclusively for persons who are 55 years of age or older or for couples, one of whom is at least 55 years of age, which provides a continuum of accommodations and care including independent living units, nursing care units and assisted living units which provide continuing care as an integral part of the residential development.
CONTRIBUTORY DRAINAGE AREA
The area from which stormwater runoff drains to a stormwater management measure, not including the area of the stormwater management measure itself.
CONVENTIONAL
Development other than planned development.
COPPICING
A silvicultural practice involving the production of forest stands from vegetative sprouting by the trees that are harvested (stump sprouts, root suckers, and naturally rooted layers). Coppicing typically involves short rotations with dense stands of short trees.
CORE
A pedestrian-oriented area of commercial and civic uses serving the surrounding municipality, generally including housing and access to public transportation.
CORRUGATED AND OTHER CARDBOARD
All corrugated cardboard normally used for packing, mailing, shipping or containerizing goods, merchandise or other material, but excluding plastic, foam or wax-coated or soiled corrugated cardboard.
COUNTY
The Burlington County Board of Chosen Freeholders, and its successors and assigns, acting through the Burlington County Department of Solid Waste.
COUNTY REVIEW AGENCY
An agency designated by the Burlington County Board of Chosen Freeholders to review municipal stormwater management plans and implementing ordinance(s). The county review agency may either be:
 
1. A county planning agency; or

2. A county water resource association created under N.J.S.A. 58:16A-55.5, if the ordinance or resolution delegates authority to approve, conditionally approve, or disapprove municipal stormwater management plans and implementing ordinances.
COUNTY REVIEW AGENCY

COUNTY SOIL SURVEY REPORT
A report prepared by the United States Department of Agriculture, Natural Resources Conservation Service, which includes maps showing the distribution of soil mapping units throughout a particular county, together with narrative descriptions of the soil series shown and other information relating to the uses and properties of the various soil series.
COVERAGE, BUILDING
The aggregate square footage or other area measurement by which all buildings occupy a lot as measured in a horizontal plane around the periphery of the facades and including the area under the roof of any structure supported by columns, but not having walls, as measured around the outside of the outermost extremities of the roof above the columns.
COVERAGE, LOT
The aggregate square footage or other area measurement by which all sidewalks, driveways and parking areas, whether paved, graveled or unsurfaced, and all buildings and other structures cover a lot as measured in a horizontal plane to the limits of the structure or improvement.
CURBSIDE DESIGNATED RECYCLABLES
Those designated recyclables that are placed for collection within the parameters of the curbside collection program as outlined herein.
CURBSIDE RECYCLING CONTAINER
A container(s) provided by the municipality or persons for the temporary storage of recyclable materials within the residential unit(s).
DCA
The State of New Jersey Department of Community Affairs.
DEFICIENT HOUSING UNIT
A housing unit with health and safety code violations that require the repair or replacement of a major system. A major system includes weatherization, roofing, plumbing (including wells), heating, electricity, sanitary plumbing (including septic systems), lead paint abatement and/or load-bearing structural systems.
DEMOLITION
The partial or total razing or destruction of any Historic Site or any improvement within the Historic District.
DENSITY/NON-PINELANDS
The permitted number of dwelling units per gross area of land to be developed.
DENSITY/PINELANDS
The average number of dwelling units per acre of land.
DEP or DEPARTMENT
The New Jersey Department of Environmental Protection.

DESIGN ENGINEER

DESIGNATED RECYCLABLE MATERIALS
Those recyclable materials to be source separated in this municipality, including but not limited to aluminum cans, antifreeze, consumer electronics, corrugated cardboard, fluorescent lights, glass containers, lead acid batteries, leaves, metal appliances, paper, plastic bottles (coded No. 1 and No. 2), rechargeable batteries, steel (tin) cans, textiles, tires and used motor oil.
DEVELOPER
The legal or beneficial owner or owners of a lot or of any land proposed to be included in a proposed development, including the holder of an option or contract to purchase, or other person having an enforceable proprietary interest in such land.

DIGITAL FLOOD INSURANCE RATE MAP (DFIRM)
The official map on which the Federal Insurance Administration has delineated both the areas of special flood hazards and the risk premium zones applicable to the community.
DIRECT SUPERVISION
Control over and direction of work carried out by others with full knowledge of and responsibility for such work.
DISKING
A silvicultural practice involving the drawing of one or more heavy, round, concave, sharpened, freely rotating steel disks across a site for the purposes of cutting through soil and roots or cutting and turning a furrow over an area.
DISTURBANCE
The placement or reconstruction of impervious surface or motor vehicle surface, or exposure and/or movement of soil or bedrock or clearing, cutting, or removing of vegetation. Milling and repaving is not considered disturbance for the purposes of this definition.
DRAINAGE
The removal of surface water or groundwater from land by drains, grading or other means and including control of runoff during and after construction or development to minimize erosion and sedimentation, to assure the adequacy of existing and proposed culverts and bridges, to induce water recharge into the ground where practical, to lessen nonpoint pollution, to maintain the integrity of stream channels for their biological functions as well as for drainage, and the means necessary for water supply preservation and prevention or alleviation of flooding.
DRAINAGE AND UTILITY RIGHT-OF-WAY
The lands required for the installation and maintenance of stormwater and sanitary sewers, water pipes or drainage ditches and other utilities, or required along a natural stream or watercourse for preserving the channel and providing for the flow of water therein to safeguard the public against flood damage.
DRAINAGE AREA
A geographic area within which stormwater, sediments, or dissolved materials drain to a BMP, a stormwater management system, a particular receiving water body or a particular point along a receiving water body.
DRAINAGE AREA

DRUM CHOPPING
A silvicultural practice involving the drawing of a large cylindrical drum with cutting blades mounted parallel to its axis across a site to break up slash, crush scrubby vegetation prior to burning or planting or to chop up and disturb the organic turf and roots in the upper foot of soil.

DWELLING
Any structure or portion thereof which is designed or used for residential purposes.
DWELLING UNIT
A room or series of connected rooms designed for permanent residency containing living, cooking, sleeping and sanitary facilities for one housekeeping unit. The dwelling shall be self-contained and shall not require the passing through another dwelling unit or other indirect route(s) to get to any other portion of the dwelling unit, nor shall there be shared facilities with another housekeeping unit.
 
APARTMENT — A building other than a building of attached "Townhouses" containing a minimum of three dwelling units and not exceeding 2.5 stories and 35 feet in height.
 
CARRIAGE HOUSE APARTMENT — A residential dwelling unit within a building accessory to a detached single-family dwelling containing both a garage for the parking of automobiles owned and used by the residents of the detached dwelling unit and the residential Carriage House Apartment dwelling unit above the garage. The Carriage House Apartment shall be restricted to occupancy by members of the same family occupying the detached single-family dwelling, shall not ever be used as a rental unit, shall be between 600 square feet and 700 square feet in net habitable floor area, and shall have a direct entrance at ground level. The height of an accessory building containing a Carriage House Apartment shall not exceed 2.5 stories and 35 feet in height.
 
DETACHED, SINGLE-FAMILY — A building physically detached from other buildings or portions of buildings which is occupied or intended to be occupied for residence purposes by one housekeeping unit which has its own sleeping, sanitary and general living facilities.
 
PATIO HOME — A single-family dwelling on an individual lot which may be attached to a second single-family dwelling on an adjacent lot.
 
RESIDENTIAL FLAT — A residential dwelling unit situated on the second floor above permitted nonresidential uses in the Easttown Planned Development and elsewhere in accordance with the applicable provisions of this ordinance.
 
TOWNHOUSE — One building containing at least four connected dwelling units, where each dwelling unit is compatibly designed in relation to all other units, but is distinct by such design features as width, setback, roof design, color, exterior materials, and other features, singularly or in combination. Each dwelling unit may be a maximum of three stories and 35 feet in height, but nothing in the definition shall be construed to allow one dwelling unit over another.
 
TWO-FAMILY — A building on one lot containing two dwelling units only, each having entrances on the first floor, intended for the residential occupancy by two housekeeping units, each living independently of each other and each unit with its own sleeping, cooking and sanitary facilities. The dwelling units shall be entirely separated from one another by vertical walls or horizontal floors, except for access to the outside or to a common basement.
EASEMENT
A use or burden imposed on real estate by deed or other legal means to permit the use of land by the municipality, public, a corporation, or particular persons for specific uses.
EAVE
The overhanging lower edge of a roof.
ECOLOGICAL MAP ATLAS
An atlas of maps at a scale of one inch equals 2,000 feet designated "Ecological Map Atlas of the Medford Report" and available for public use and inspection at the office of the Medford Township Administration Office.
ECOLOGICAL REPORT
A study prepared in 1970 for Medford Township by the Center for Ecological Research in Planning and Design, Department of Landscape Architecture and Regional Planning, University of Pennsylvania, including:

A. A document entitled "An Ecological Planning Study of Medford Township, New Jersey."

B. The Ecological Map Atlas as herein defined.

C. Photographic slides of each of the 19 maps identified in said draft as described above and numerous related photographic slides depicting maps, charts, graphs and associated ecological data.

D. The Natural Resource Inventory (NRI) of Medford Township prepared in accordance with the Pinelands CMP by the Township Planning Department.
EFFECTIVE RUNWAY LENGTH
That distance measured along a runway centerline, from a point on the runway surface where there is a specified slope intersection from obstacles within a specified approach zone to the runway in the direction of travel during the landing. In regard to initial licensing criteria, the effective runway length is affected and reduced by runway gradient to the extent of 20% for each 1% of longitudinal gradient in excess of 2% longitudinal gradient.
ELECTRIC DISTRIBUTION LINES
All electric lines other than electric transmission lines.
ELECTRIC TRANSMISSION LINES
Electric lines which are part of an electric company's transmission and subtransmission system, which provide a direct connection between a generating station or substation of the utility company and:
(a) another substation of the utility company;
(b) a substation of or interconnection point with another interconnecting utility company; or
(c) a substation of a high-load customer of the utility.
ELEVATED BUILDING
A nonbasement building i) built, in the case of a building in an area of special flood hazard, to have the top of the elevated floor elevated above the base flood elevation plus freeboard by means of piling, columns (posts and piers), or shear walls parallel to the flow of the water, and ii) adequately anchored so as not to impair the structural integrity of the building during a flood up to the magnitude of the base flood. In an area of special flood hazard, "elevated building" also includes a building elevated by means of fill or solid foundation perimeter walls with openings sufficient to facilitate the unimpeded movement of floodwaters.
EMPOWERMENT NEIGHBORHOODS
Neighborhoods designated by the Urban Coordinating Council "in consultation and conjunction with" the New Jersey Redevelopment Authority pursuant to N.J.S.A. 55:19-69.
ENLARGEMENT
An addition to the floor area of an existing building, an increase in the size of any other existing structure, or an increase in that portion of a tract of land occupied by an existing use.
ENVIRONMENTALLY CONSTRAINED AREA
The following areas where the physical alteration of the land is in some way restricted, either through regulation, easement, deed restriction or ownership, such as: wetlands, floodplains, threatened and endangered species sites or designated habitats, and parks and preserves. Habitats of endangered or threatened species are identified using the Department's Landscape Project as approved by the Department's Endangered and Nongame Species Program.
ENVIRONMENTALLY CRITICAL AREA
An area or feature which is of significant environmental value, including but not limited to stream corridors, natural heritage priority sites, habitats of endangered or threatened species, large areas of contiguous open space or upland forest, steep slopes, and wellhead protection and groundwater recharge areas. Habitats of endangered or threatened species are identified using the Department's Landscape Project as approved by the Department's Endangered and Nongame Species Program.
ENVIRONMENTALLY CRITICAL AREA
An area or feature which is of significant environmental value, including, but not limited to: stream corridors; natural heritage priority sites; habitats of endangered or threatened animal species; threatened or endangered plants of the Pinelands pursuant to N.J.A.C. 7:5-6.27(a); large areas of contiguous open space or upland forest; steep slopes; and wellhead protection and groundwater recharge areas. T&E habitat constitutes habitat that is critical for the survival of a local population of threatened and endangered species or habitat that is identified using the Department's Landscape Project as approved by the Department's Endangered and Nongame Species Program, whichever is more inclusive. Threatened and endangered wildlife shall be protected in conformance with N.J.A.C. 7:50-6.33.
EQUALIZED ASSESSED VALUE
The assessed value of a property divided by the current average ratio of assessed to true value for the municipality in which the property is situated; as determined in accordance with Sections 1, 5, and 6 of P.L. 1973, c. 123 (N.J.S.A. 54:1-35a through 54:1-35c).
EQUIVALENT SPHERICAL DIAMETER OF A PARTICLE
The diameter of a sphere which has a volume equal to the volume of the particle.
EROSION
The detachment and movement of soil or rock fragments by water, wind, ice, or gravity.

EXCEPTION

EXCESSIVELY COARSE HORIZON
A horizon of limited thickness within the soil profile which provides inadequate removal of pollutants from stormwater due to a high coarse fragment content, excessively coarse texture and/or excessively rapid permeability.
EXCESSIVELY COARSE SUBSTRATUM
A substratum below the soil profile which extends beyond the depth of soil profile pits and borings and which provides inadequate removal of pollutants from stormwater due to a high coarse fragment content, excessively coarse texture and/or excessively rapid permeability.
EXECUTIVE DIRECTOR
The chief administrative officer of the Pinelands Commission or any representative designated by such chief administrative officer to perform any functions delegated to such chief administrative officer pursuant to any portion of the Pinelands Comprehensive Management Plan.
EXISTING MANUFACTURED HOME PARK OR SUBDIVISION
A manufactured home park or subdivision for which the construction of facilities for servicing the lots on which the manufactured homes are to be affixed (including, at a minimum, the installation of utilities, the construction of streets, and either final site grading or the pouring of concrete pads) is completed before the effective date of the floodplain management regulations adopted by a community.
EXTENDED DETENTION BASIN
A facility constructed through filling and/or excavation that provides temporary storage of stormwater runoff. It has an outlet structure that detains and attenuates runoff inflows and promotes the settlement of pollutants. An extended detention basin is normally designed as a multi-stage facility that provides runoff storage and attenuation for both stormwater quality and quantity management. The term "stormwater detention basin" shall have the same meaning as "extended detention basin."
EXTREMELY FIRM CONSISTENCE
A type of soil material whose moist aggregated mass crushes only under very strong pressure; cannot be crushed between the thumb and forefinger and shall be broken apart bit by bit.
FACADE, BUILDING
The front wall or any of the sides of a building facing a public street, park, parking area, or plaza, which shall be distinguished by its architectural treatment.
FAIR SHARE PLAN
The plan or proposal, which is in the form that may readily be converted into an ordinance, by which a municipality proposes to satisfy its obligation to create a realistic opportunity to meet the low- and moderate-income housing need of its region, and which details the affirmative measures the municipality proposes to undertake to achieve its fair share of low- and moderate-income housing, as provided by Sections 9 and 14 of the Act, and as further described and defined in N.J.A.C. 5:93.
FAMILY
Shall mean the same as "Housekeeping Unit."
FAMILY DAY CARE HOME
Any private residence approved by the Division of Youth and Family Services or an organization with which the Division contracts for family day care in which child care services are regularly provided to no less than three and no more than five children for no less than 15 hours per week. A child being cared for under the following circumstances is not included in the total number of children receiving child care services:

A. A child being cared for is legally related to the provider; or

B. The child is being cared for as part of a cooperative agreement between parents for the care of their children by one or more of the parents, where no payment for the care is being provided.
FENCE
An artificially constructed barrier of wood, masonry, stone, wire, metal or any other manufactured material or combination of materials, erected for the enclosure or partial enclosure, screen or partial screen or separation of areas.
FENCE, OPEN
A fence constructed with openings between the materials used for construction. Examples of open fences include but are not limited to traditional wood picket or split rail.
FENCE, SOLID
A fence, constructed of solid material, wood or masonry, through which no visual images may be seen. Examples of solid fences include but are not limited to board-on-board, solid wood or manufactured material fence or masonry.
FIBER
All newspaper, fine paper, bond paper, junk mail, office paper, magazines, paperback books, school paper, catalogs, computer paper, telephone books, chipboard, corrugated and other cardboard and similar cellulosic material, whether shredded or whole, but excluding wax paper, plastic or foil-coated paper, thermal fax paper, carbon paper, blueprint paper, food-contaminated paper, soiled paper and cardboard.
FINISHED GRADE
The elevation of the surface of the ground after completion of final grading, either via cutting, filling or a combination thereof.
FIRE OFFICIAL
An individual designated by the Township of Medford and certified by the Commissioner of the New Jersey State Department of Community Affairs to serve as the "Fire Official."
FIRE SUBCODE OFFICIAL
A qualified individual appointed by the Township of Medford to enforce the fire protection rules of the New Jersey Uniform Construction Code (N.J.A.C. 5:23-1 et seq.) which are within the jurisdiction of the Township.
FIRM CONSISTENCE
A type of soil material whose moist aggregated mass crushes under moderate pressure between the thumb and forefinger, but resistance is distinctly noticeable.
FISH AND WILDLIFE MANAGEMENT
The changing of the characteristics and interactions of fish and wildlife populations and their habitats in order to promote, protect and enhance the ecological integrity of those populations.
FIXED OR MOVABLE OBSTRUCTION
"Fixed or movable obstruction," when used in the context of "obstacle free zone," means any use of land or water, including lateral taxiway to runway centerline clearance and any man-made or natural structure or body that is fixed or movable that is higher than one meter. Objects such as visual approach slope indicators, wind indicators, and the like, are exempted from being such "fixed or movable obstructions" when they are mounted on frangible posts. Crops also may be exempted upon application and review.
FLAG LOT
A lot configuration having a reduced frontage on an improved street with the enlarged buildable portion at the rear of the lot; the buildable portion shall comply with ordinance standards exclusive of the stem portion of the lot.
FLOOD FRINGE AREA
That portion of the flood hazard area outside of the floodway.
FLOOD HAZARD AREA
Land in the floodplain subject to a one-percent or greater chance of flood in any given year.
FLOOD HAZARD AREA (FHA)
Land, and the space above that land, which lies below the flood hazard area design flood elevation. Structures, fill and vegetation that are situated on land that lies below the flood hazard area design flood elevation are described as being "in" or "within" the flood hazard area. The inner portion of the flood hazard area is called the "floodway" and the outer portion of the flood hazard area is called the "flood fringe." Figures A and B at N.J.A.C. 7:13-2.3 illustrate these areas as well as the riparian zone along a typical water. The flood hazard area on a particular site is determined using the methods set forth at N.J.A.C. 7:13-3. There are two types of flood hazard areas:

1. Tidal flood hazard area, in which the flood hazard area design flood elevation is governed by tidal flooding from the Atlantic Ocean. Flooding in a tidal flood hazard area may be contributed to or influenced by stormwater runoff from inland areas, but the depth of flooding generated by the tidal rise and fall of the Atlantic Ocean is greater than flooding from any fluvial sources; and

2. Fluvial flood hazard area, in which the flood hazard area design flood elevation is governed by stormwater runoff. Flooding in a fluvial flood hazard area may be contributed to or influenced by elevated water levels generated by the tidal rise and fall of the Atlantic Ocean, but the depth of flooding generated by stormwater runoff is greater than flooding from the Atlantic Ocean.
FLOOD HAZARD AREA DESIGN FLOOD
A flood equal to the 100-year flood plus an additional amount of water in fluvial areas to account for possible future increases in flows due to development or other factors. This additional amount of water also provides a factor of safety in cases when the 100-year flood is exceeded. N.J.A.C. 7:13-3 describes the various methods of determining the flood hazard area design flood for a particular water as well as the additional amount of water to be added in various situations.
FLOOD INSURANCE RATE MAP (FIRM)
The official map on which the Federal Insurance Administration has delineated both the areas of special flood hazards and the risk premium zones applicable to the community.
FLOOD INSURANCE STUDY (FIS)
The official report in which the Federal Insurance Administration has provided flood profiles, as well as the Flood Insurance Rate Map(s) and the water surface elevation of the base flood.
FLOOD or FLOODING
A general and temporary condition of partial or complete inundation of normally dry land areas from:

1. The overflow of inland or tidal waters; and/or

2. The unusual and rapid accumulation or runoff of surface waters from any source.
FLOODPLAIN
The relatively flat area adjoining a water channel which has been or may be covered by flood water of the channel, including the following components:
FLOODPLAIN MANAGEMENT REGULATIONS
Zoning ordinances, subdivision regulations, building codes, health regulations, special purpose ordinances (such as a floodplain ordinance, grading ordinance and erosion control ordinance) and other applications of police power. The term describes such state or local regulations, in any combination thereof, which provide standards for the purpose of flood damage prevention and reduction.
FLOODPROOFING
Any combination of structural and nonstructural additions, changes, or adjustments to structures which reduce or eliminate flood damage to real estate or improved real property, water and sanitary facilities, structures and their contents.
FLOODWAY
The channel of a river or other watercourse and the adjacent land areas that must be reserved in order to discharge the base flood without accumulatively increasing the water surface elevation more than 0.2 foot.
FLOODWAY
The river or other watercourse and the adjacent land area that must be reserved in order to discharge the design flood without cumulatively increasing the water surface elevation more than 0.2 of a foot.
FLOOR AREA RATIO (F.A.R.)
The ratio of the gross floor area to the area of the lot or tract.
FLOOR AREA, GROSS (G.F.A.)
The plane projection of all roofed areas on a lot multiplied by the number of full stories under each roof section provided that the area under any roof overhang of four feet or less and/or any under roof parking area shall not be included in the G.F.A. calculation. Basements which satisfy applicable construction definitions of habitable space are included in the G.F.A.
FLOOR AREA, NET HABITABLE (N.H.F.A.)
The finished and heated area fully enclosed by the inside surfaces of walls, windows, doors and partitions and having a headroom of at least 6 1/2 feet including working, living, eating, cooking, sleeping, stair, hall, service and storage areas, but excluding garages, carports, parking spaces, cellars, utility (heating and cooling) rooms, half-stories and unfinished attics and basements.
FOREST STAND
A uniform group of trees of similar species, composition, size, age and similar forest structure.
FORESTRY
The planting, cultivating and harvesting of trees for the production of wood products, including firewood or for forest health. It includes such practices as reforestation, site preparation and other silvicultural practices, including but not limited to artificial regeneration, bedding, broadcast scarification, clearcutting, coppicing, disking, drum chopping, group selection, individual selection, natural regeneration, root raking, seed tree cut, shelterwood cut and thinning. For purposes of this ordinance, the following activities shall not be defined as forestry:

A. Removal of trees located on a parcel of land one acre or less on which a dwelling has been constructed;

B. Horticultural activities involving the planting, cultivating or harvesting of nursery stock or Christmas trees;

C. Removal of trees necessitated by the development of the parcel as otherwise authorized by this ordinance;

D. Removal of trees necessary for the maintenance of utility or public rights-of-way;

E. Removal or planting of trees for the personal use of the parcel owner; and

F. Removal of trees for public safety.
FREEBOARD
A factor of safety usually expressed in feet above a flood level for purposes of floodplain management. Freeboard tends to compensate for the many unknown factors that could contribute to flood heights greater than the height calculated for a selected size flood and floodway conditions, such as wave action, bridge openings, and the hydrological effect of urbanization of the watershed.
GARAGE, PRIVATE NONRESIDENTIAL
A structure which is accessory to a nonresidential building and use and which is used primarily for the parking and storage of vehicles operated by the customers, visitors and employees of such nonresidential building and use, and which is not available to the general public.
GARAGE, PRIVATE RESIDENTIAL
A structure which is associated with a residential building and which is used for the parking and storage of vehicles owned and operated by the residents thereof, and which is not a separate commercial enterprise available to the general public. A private residential garage shall have capacity for not more than three motor vehicles, shall not exceed a width of 45 feet, and shall not exceed a depth of 24 feet. Additionally, a detached private residential garage shall not exceed a height of 20 feet.
GARAGE, PUBLIC
A building or portion thereof, other than a private nonresidential garage or private residential garage, used primarily for the parking and storage of vehicles and available to the general public.
GARAGE, REPAIR
Any building, premises and land in which or upon which a business, service or industry involving the maintenance, servicing, repair or painting of vehicles is conducted or rendered.
GATE
An opening in a fence to permit access, or an artificial barrier capable of being opened and closed, permitting or denying access to an area.
GENERAL DEVELOPMENT PLAN
A comprehensive plan for the development of a "Planned Development" in accordance with the provisions specified in § 807: Submission of Optional General Development Plans for Planned Developments of this ordinance.
GRADE
The slope of a road, path, driveway, swale or other surface or the average finished ground elevation adjoining a building at project completion.
GRADING
Modification of a land slope by cutting and filling with the native soil or redistribution of the native soil which is present at the site.
GREEN BUILDING STRATEGIES
Those strategies that minimize the impact of development on the environment, and enhance the health, safety and well-being of residents by producing durable, low-maintenance, resource-efficient housing while making optimum use of existing infrastructure and community services.
GREEN INFRASTRUCTURE
A stormwater management measure that manages stormwater close to its source by:
 
1. Treating stormwater runoff through infiltration into subsoil;

2. Treating stormwater runoff through filtration by vegetation or soil; or

3. Storing stormwater runoff for reuse.
GROSS DENSITY, CCRC
For the purposes of calculating gross density for the CCRC, each individual living unit shall be one dwelling unit, each assisted living unit shall be one dwelling unit and each bed in a nursing care unit shall be one dwelling unit.
GROUNDWATER
Water below the land surface in a zone of saturation.
GROUNDWATER MOUNDING ANALYSIS
A test performed to demonstrate that the groundwater below a stormwater infiltration basin will not "mound up," encroach on the unsaturated zone, break the surface of the ground at the infiltration area or downslope, and create an overland flow situation.
GROUP SELECTION
A silvicultural practice whereby a group of trees is periodically selected to be removed from a large area so that age and size classes of the reproduction are mixed.
HABITAT
The natural environment of an individual animal or plant, population or community.
HARD CONSISTENCE
A type of soil material whose dry aggregated mass is moderately resistant to pressure; can be broken in the hands without difficulty but is barely breakable between the thumb and forefinger.
HEAVY EQUIPMENT
Equipment, machinery, or vehicles that exert ground pressure in excess of eight pounds per square inch.
HIGH POLLUTANT LOADING AREA
An area in an industrial or commercial development site: where solvents and/or petroleum products are loaded/unloaded, stored, or applied; where pesticides are loaded/unloaded or stored; where hazardous materials are expected to be present in greater than "reportable quantities" as defined by the United States Environmental Protection Agency (EPA) at 40 CFR 302.4; where recharge would be inconsistent with an NJDEP-approved remedial action work plan or landfill closure plan; and/or where a high risk exists for spills of toxic materials, such as gas stations and vehicle maintenance facilities. The term "HPLA" shall have the same meaning as "high pollutant loading area."
HIGHEST ADJACENT GRADE
The highest natural elevation of the ground surface prior to construction next to the proposed or existing walls of a structure.
HISTORIC DISTRICT
The Historic District as delineated on the "Medford Village Historic Preservation and Growth Plan" map within the Comprehensive Master Plan of the Township and including those lands within the "Historic Village Commercial," "Historic Village Residential," and "Residential Home Occupation" Districts. Additionally, those lands within the "Planned Industrial" and/or "Restricted Commercial" Districts which are adjacent the three aforementioned Districts shall be subject to the "Historic Preservation" requirements specified herein.
HISTORIC RESOURCE
Any site, building, area, district, structure or object important in American history or pre-history, architecture, archaeology and culture at the national, state, county, local or regional level.
HISTORIC SITE
Any real property, man-made structure, natural object or configuration, or any portion or group of the foregoing, which has been formally designated as an "Historic Site" within the Comprehensive Master Plan of the Township.
HISTORIC STRUCTURE
Any structure that is:

1. Listed individually in the National Register of Historic Places (a listing maintained by the Department of Interior) or preliminarily determined by the Secretary of the Interior as meeting the requirements for individual listing on the National Register;

2. Certified or preliminarily determined by the Secretary of the Interior as contributing to the historical significance of a registered historic district or a district preliminarily determined by the Secretary to qualify as a registered historic district;

3. Individually listed on a state inventory of historic places in states with historic preservation programs which have been approved by the Secretary of the Interior; or

4. Individually listed on a local inventory of historic places in communities with historic preservation programs that have been certified either:
a. By an approved state program as determined by the Secretary of the Interior; or
b. Directly by the Secretary of the Interior in states without approved programs.
HISTORIC STRUCTURE, BUILDING OR SITE
A structure, building, or place of historic, architectural or cultural significance and designated as such by municipal, county, state or federal governments, and/or in the Medford Township Master Plan.
HOME OCCUPATION
An activity for economic gain, carried out in a residential dwelling or accessory structure thereto, in which an occupant of the residence and not more than one additional individual is employed, which activity is clearly secondary to the use of the residence as a dwelling, and which meets the requirements specified in § 602 of this ordinance.
HOMEOWNERS' ASSOCIATION
An organization operating in a development under recorded agreements through which each lot owner shall be a member and each dwelling unit is subject to a charge for a proportionate share of the expenses for the organization's activities and maintenance, including any maintenance costs levied against the association by the Township in accordance with N.J.S.A. 40:55D-43.
HOTELS AND MOTELS
A building or group of buildings consisting of individual sleeping units designed for transient travelers and not for permanent residency, except that up to 3% of the total units may be provided for the sole use of resident employees.
HOUSEKEEPING UNIT
One or more persons living together in one dwelling unit on a non-seasonal basis and sharing living, sleeping, cooking and sanitary facilities on a nonprofit basis.
HOUSING ELEMENT
The portion of the Township's Master Plan, consisting of reports, statements, proposals, maps, diagrams and text, designed to meet the municipality's fair share of its region's present and prospective housing needs, particularly with regard to low- and moderate-income housing, as further described at Section 10 of the Act and by N.J.A.C. 5:93.
HUC 14 or HYDROLOGIC UNIT CODE 14
An area within which water drains to a particular receiving surface water body, also known as a "subwatershed," which is identified by a fourteen-digit hydrologic unit boundary designation, delineated within New Jersey by the United States Geological Survey.
HUE
The dominant spectral color, one of the three variables of soil color defined within the Munsell system of classification.
HYDRAULICALLY RESTRICTIVE HORIZON
A horizon within the soil profile which slows or prevents the downward or lateral movement of water and which is underlain by permeable soil horizons or substrata. Any soil horizon which has a saturated permeability less than 1.0 inch per hour is hydraulically restrictive.
HYDRAULICALLY RESTRICTIVE SUBSTRATUM
A substratum below the soil profile which slows or prevents the downward or lateral movement of water and which extends beyond the depth of profile pits or borings or to a massive substratum. A substratum which has a saturated permeability less than 1.0 inch per hour is hydraulically restrictive.
HYDROPHYTE
Any plant growing in water or in substrate that is at least periodically deficient in oxygen as a result of excessive water content.
IMMEDIATE FAMILY
Those persons related by blood or legal relationship in the following manner: spouses, domestic partners, great grandparents, grandparents, great grandchildren, grandchildren, parents, sons, daughters, brothers and sisters, aunts and uncles, nephews, nieces and first cousins.
IMPERMEABLE SURFACE
Any surface which does not permit fluids to pass through or penetrate its pores or spaces, typically having a maximum permeability for water of 10-7 cm/second at the maximum anticipated hydrostatic pressure. The term "impermeable" is equivalent in meaning.
IMPERVIOUS SURFACE
Any surface that has been compacted or covered with a layer of material so that it prevents, impedes or slows infiltration or absorption of fluid, including stormwater, directly into the ground and results in either reduced groundwater recharge or increased stormwater runoff sufficient to be classified as impervious in urban areas, by the United States Department of Agriculture, Natural Resources Conservation Service, Title 210 - Engineering, 210-3-1, Small Watershed Hydrology (WINTR-55), Version 1.0. Such surfaces may have varying degrees of permeability.
IMPERVIOUS SURFACE
A surface that has been covered with a layer of material so that it is highly resistant to infiltration by water.
IMPROVEMENT
Any structure or any part thereof constructed or installed upon real property by human endeavor and intended to be kept at the location of such construction or installation for a period of not less than 60 continuous days.
INCLUSIONARY DEVELOPMENT
A development containing both affordable units and market-rate units. This term includes, but is not limited to, new construction, the conversion of a nonresidential structure to residential use and the creation of new affordable units through the reconstruction of a vacant residential structure.
INDEPENDENT LIVING UNIT
A dwelling unit in a continuing care retirement community which is unrestricted except as to an age requirement for occupancy and is not an assisted living unit or a nursing care unit as defined herein. Each dwelling unit shall be counted as one dwelling unit for the purposes of calculating overall gross density.
INDIVIDUAL SELECTION
A silvicultural practice whereby single trees are periodically selected to be removed from a large area so that age and size classes of the reproduction are mixed.
INDUSTRIAL PARK
Any tract(s) of land that is/are developed and operated as a coordinated and integrated facility, in separate buildings or one building, for a number of separate industrial uses, with consideration for circulation, parking, loading, signage, and utility needs.
INFILTRATION
The process by which precipitation enters the soil through its surface.
INFILTRATION
The process by which water seeps into the soil from precipitation.
IN-LIEU CONTRIBUTION
A monetary fee collected by Medford Township in lieu of requiring strict on-site compliance with the groundwater recharge, stormwater runoff quantity and/or stormwater runoff quality standards established in this section.
INSTALL
To assemble, construct, put in place or connect components of a stormwater management system.
INSTITUTIONAL USE
Any land used for the following public or private purposes: educational facilities including universities, colleges, elementary and secondary and vocational schools, kindergartens and nurseries; cultural facilities such as libraries, galleries, museums, concert halls, theaters and the like; churches; public office buildings; hospitals, including such educational, clinical, research and convalescent facilities as are integral to the operation of the hospital; medical and health service facilities, including nursing homes, rehabilitation therapy centers and public health facilities; law enforcement facilities; military facilities; and other similar facilities. For purposes of this ordinance, institutional use shall not include medical offices which are not associated with hospitals or other medical or health service facilities, nor shall it include assisted living facilities.
INTERESTED PERSONS
Any person or entity inquiring as to the purchase of the property or otherwise seeking information on the property.
JUNKYARD
Any area of land, with or without buildings, devoted to the storage, keeping or abandonment of junk or debris, whether or not it is in connection with the dismantling, processing, salvage, sale or other use or disposition thereof or of any material whatsoever.
LAND
The surface and subsurface of the earth as well as improvements and fixtures on, above, or below the surface and any water found thereon.
LANDFILL
Sites, including open dumps, where solid waste, liquid and dry sewage sludge and liquid and dry chemical waste are disposed of by land application with or without the use of management practices or soil covering. For the purposes of this ordinance, solid waste transfer stations shall not be considered "landfills."
LEAD PLANNING AGENCY
One or more public entities having stormwater management planning authority designated by the regional stormwater management planning committee pursuant to N.J.A.C. 7:8-3.2 that serves as the primary representative of the committee.
LIGHT REFLECTANCE VALUE (LRV)
The LRV indicates the amount of visible light that a color will reflect. In theory, true black has an LRV of 0% and absorbs all light; and conversely, true white has a high reflectance value of 100% and reflects all light. All color samples have an LRV, such as paint chips contain the LRV on the back of the chip.
LIMITED TAKE-OUT SERVICE
Ancillary services typically provided by retail food establishments or sit-down restaurants, whereby foodstuffs are packaged to consume off premises and are limited to no more than 5% of their gross retail business.
LOADING SPACE
An off-street parking space or berth on the same lot with a building or group of buildings for the temporary parking of a commercial vehicle while loading or unloading.
LOAMY SAND
A soil textural class, as shown in Subsection K.3.a (USDA Soil Textural Triangle), that has a maximum of 85% to 90% sand with a percentage of silt plus 1.5 times the percentage of clay not in excess of 15; or a minimum of 70% to 85% sand with a percentage of silt plus 1.5 times the percentage of clay not in excess of 30.
LOCAL COMMUNICATIONS FACILITY
An antenna and any support structure, together with any accessory facilities, which complies with the standards in N.J.A.C. 7:50-5.4 and which is intended to serve a limited, localized audience through point to point communication, including cellular telephone cells, paging systems and dispatch communications. It does not include radio or television broadcasting facilities or microwave transmitters.
LOT
A designated parcel, tract or area of land established by a plat or otherwise as permitted by law and to be used, developed or built upon as a unit.
LOT AREA
The area contained within the lot lines, but not including any portion of a street, lake or stream. The minimum "lot area" of a lot fronting on a street proposed to be widened in the adopted Master Plan shall be the minimum area required for the district in which it is located plus the additional area needed to anticipate the ultimate widening of the street.
LOT DEPTH
The shortest horizontal distance between the front lot line and a line drawn parallel to the front lot line through the mid-point of the rear lot line.


 
LOT FRONTAGE
The horizontal distance between the side lot lines measured along the street line. The minimum lot frontage shall be the same as the lot width, except that on curved alignments with an outside radius of less than 500 feet measured from the centerline of the street, the minimum distance between the side lot lines measured at the street line shall not be less than 75% of the required minimum lot width unless a lesser frontage is specified in this ordinance. In the case of a corner lot, either street frontage which meets the required frontage for that zone may be considered the "lot frontage."
LOT LINE
Any line forming a portion of the exterior boundary of a lot. The "lot line" is the same line as the "street line" for a portion of a lot abutting a street. "Lot lines" extend vertically in both directions from ground level.
LOT WIDTH
The straight and horizontal distance between the side lot lines measured at setback points on each side lot line an equal distance from the street line. The minimum lot width shall be measured at the minimum required building setback line.
LOT, CORNER
A lot on the junction of land abutting two or more intersecting streets where the interior angle of intersection does not exceed 120°. Each corner lot shall have two front yards, one side and one rear yard, the side and rear yards to be designated at the time of application for a construction permit.
LOT, REVERSE FRONTAGE
A through lot, i.e., a lot that fronts upon two streets that do not intersect at the boundaries of the lot and that is not accessible from one of the parallel or nonintersecting streets upon which it fronts.
LOWER PLASTIC LIMIT
The moisture content corresponding to the transition between the plastic and semisolid states of soil consistency. This corresponds to the lowest soil moisture content at which the soil can be molded in the fingers to form a rod or wire, 1/8 inch in thickness, without crumbling.
LOWEST FLOOR
The lowest floor of the lowest enclosed area (including basement). An unfinished or flood-resistant enclosure, usable solely for the parking of vehicles, building access or storage in an area other than a basement, is not considered a building's lowest floor provided that such enclosure is not built so to render the structure in violation of other applicable nonelevation design requirements of 44 CFR 60.3.
LOW-INCOME HOUSEHOLD
A household with a total gross annual household income equal to 50% or less of the median household income for the applicable housing region.
LOW-INCOME UNIT
A restricted unit that is affordable to a low-income household.
MAINTENANCE BOND
Any security acceptable to the governing body to assure the maintenance of duly approved improvements installed by the developer after the final inspection of the improvements and in accordance with this ordinance.
MAJOR DEVELOPMENT
1. An individual development, as well as multiple developments that individually or collectively result in:
 
a. The disturbance of one or more acres of land since February 2, 2004;

b. The creation of 1/4 acre or more of regulated impervious surface since February 2, 2004;

c. The creation of 1/4 acre or more of regulated motor vehicle surface since March 2, 2021 (or the effective date of this section, whichever is earlier); or

d. A combination of Subsections b and c above that totals an area of 1/4 acre or more. The same surface shall not be counted twice when determining if the combination area equals 1/4 acre or more.
 
2. Major development includes all developments that are part of a common plan of development or sale (for example, phased residential development) that collectively or individually meet any one or more of Subsections a, b, c, or d above. Projects undertaken by any government agency that otherwise meet the definition of "major development" but which do not require approval under the Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq., are also considered "major development."
MAJOR SYSTEM
The primary structural, mechanical, plumbing, electrical, fire protection, or occupant service components of a building, which include, but are not limited to, weatherization, roofing, plumbing (including wells), heating, electricity, sanitary plumbing (including septic systems), lead paint abatement or load-bearing structural systems.
MANUFACTURED HOME
A structure, transportable in one or more sections, which is built on a permanent chassis and is designed for use with or without a permanent foundation when attached to the required utilities. The term "manufactured home" does not include a recreational vehicle.
MANUFACTURED HOME PARK or MANUFACTURED HOME SUBDIVISION
A parcel (or contiguous parcels) of land divided into two or more manufactured home lots for rent or sale.
MARKET-RATE UNITS
Housing not restricted to low- and moderate-income households that may sell or rent at any price.
MASTER PLAN
A composite of the mapped and written plans recommending the physical development of the municipality which shall have been adopted by the Planning Board.
MEAN ELEVATION
The average of the ground level measurements computed at the four extreme corner points of any proposed or existing building.
MEDFORD TOWNSHIP
The Planning Board, Zoning Board of Adjustment or other board, agency or official of Medford Township with authority to approve or disapprove subdivisions, site plans, construction permits, building permits or other applications for development approval. For the purposes of reviewing development applications and ensuring compliance with the requirements of this section, Medford Township may designate the Township Engineer or other qualified designee to act on behalf of Medford Township.
MEDIAN INCOME
The median income by household size for the applicable housing region, as adopted annually by COAH or approved by the NJ Superior Court.
MEMORIAL
Any structure or object, regardless of material, erected within a cemetery to serve as a permanent testament to the memory of a deceased human being.
MITIGATION
Acts necessary to prevent, limit, remedy or compensate for conditions that may result from those cases where an applicant has demonstrated the inability or impracticality of strict compliance with the stormwater management requirements set forth in N.J.A.C. 7:8, in an adopted regional stormwater management plan, or in a local ordinance which is as protective as N.J.A.C. 7:8, and an exception from strict compliance is granted by Medford Township and the Pinelands Commission.
MIXED-USE CENTER
Any tract(s) of land containing a building or group of buildings in which there may be a mix of uses, such as, but not limited to, residential, offices, or retail sales and service suites. There may be shared open space, circulation, parking, loading, signage, and utility service.
MOBILE HOME
A dwelling unit manufactured in one or more sections, designed for long-term occupancy and which can be transported after fabrication to a site where it is to be occupied.
MOBILE HOME PARK
Any park, including a trailer park or camp, equipped to handle mobile homes sited on a year-round basis as defined in N.J.S.A. 2A:18-61.7 et seq.
MODERATE-INCOME HOUSEHOLD
A household with a total gross annual household income in excess of 50% but less than 80% of the median household income for the applicable housing region.
MODERATE-INCOME UNIT
A restricted unit that is affordable to a moderate-income household.
MONUMENT
Any structure or object, regardless of material, erected within a cemetery to serve as a permanent testament to the memory of a deceased human being.
MOTOR VEHICLE
Land vehicles propelled other than by muscular power, such as automobiles, motorcycles, autocycles, and low-speed vehicles. For the purposes of this definition, "motor vehicle" does not include farm equipment, snowmobiles, all-terrain vehicles, motorized wheelchairs, go-carts, gas buggies, golf carts, ski-slope grooming machines, or vehicles that run only on rails or tracks.
MOTOR VEHICLE SURFACE
Any pervious or impervious surface that is intended to be used by motor vehicles and/or aircraft, and is directly exposed to precipitation, including, but not limited to, driveways, parking areas, parking garages, roads, racetracks, and runways.
MOTTLING
A color pattern observed in soil consisting of blotches or spots of contrasting color. The term "mottle" refers to an individual blotch or spot. The terms "color variegation," "iron depletion" and "iron concentration" are equivalent to the term "mottling." Mottling due to redoximorphic reactions is an indication of seasonal or periodic and recurrent saturation.
MULTIFAMILY DWELLING
Any building or structure or complex of buildings or structures in which three or more dwelling units are rented or leased or offered for rental or lease for residential purposes; whether privately or publicly financed, except hotels, motels or other guest houses serving transient or seasonal guests as those terms are defined under subsection (j) of Section 3 of the Hotel and Multiple Dwelling Law, P.L. 1967, c. 76 (N.J.S.A. 55:13A-1 et seq.) and N.J.S.A. 40:66-1.2 et seq.
MUNICIPAL AGENCY
The Planning Board, Board of Adjustment, or Township Council, or any agency created by or responsible to one or more municipalities when acting pursuant to N.J.S.A. 40:55D-1 et seq.
MUNICIPAL SOLID WASTE
Residential, commercial and institutional solid waste generated within a community.
MUNICIPALITY
The Township of Medford located within the County of Burlington, State of New Jersey.
MUNICIPALITY
Any city, borough, town, township, or village.
MUNSELL SYSTEM
A system of classifying soil color consisting of an alpha-numeric designation for hue, value and chroma, such as "7.5 YR 6/2," together with a descriptive color name, such as "strong brown."
NATURAL REGENERATION
The establishment of a plant or plant age class from natural seeding, sprouting, suckering or layering.
NEW CONSTRUCTION
Structures for which the start of construction commenced on or after the effective date of a floodplain regulation adopted by a community and includes any subsequent improvements to such structures.
NEW JERSEY STORMWATER BEST MANAGEMENT PRACTICES (BMP) MANUAL or BMP MANUAL
The manual maintained by the Department providing, in part, design specifications, removal rates, calculation methods, and soil testing procedures approved by the Department as being capable of contributing to the achievement of the stormwater management standards specified in this chapter. The BMP Manual is periodically amended by the Department as necessary to provide design specifications on additional best management practices and new information on already included practices reflecting the best available current information regarding the particular practice and the Department's determination as to the ability of that best management practice to contribute to compliance with the standards contained in this chapter. Alternative stormwater management measures, removal rates, or calculation methods may be utilized, subject to any limitations specified in this chapter, provided the design engineer demonstrates to the municipality, in accordance with Subsection D.6 of this section and N.J.A.C. 7:8-5.2(g), that the proposed measure and its design will contribute to achievement of the design and performance standards established by this chapter.
NEW JERSEY STORMWATER BEST MANAGEMENT PRACTICES MANUAL
Guidance developed by the New Jersey Department of Environmental Protection, in coordination with the New Jersey Department of Agriculture, the New Jersey Department of Community Affairs, the New Jersey Department of Transportation, municipal engineers, county engineers, consulting firms, contractors, and environmental organizations, to address the standards in the New Jersey Stormwater Management Rules, N.J.A.C. 7:8. The BMP Manual provides examples of ways to meet the standards contained in the rule. An applicant may demonstrate that other proposed management practices will also achieve the standards established in the rules. The Manual, and notices regarding future versions of the Manual, are available from the Division of Watershed Management, NJDEP, PO Box 418, Trenton, New Jersey 08625 and on the NJDEP's website, www.njstormwater.org. The term "New Jersey BMP Manual" shall have the same meaning as "New Jersey Stormwater Best Management Practices Manual."
NEW MANUFACTURED HOME PARK OR SUBDIVISION
A manufactured home park or subdivision for which the construction of facilities for servicing the lots on which the manufactured homes are to be affixed (including, at a minimum, the installation of utilities, the construction of streets, and either final site grading or the pouring of concrete pads) is completed on or after the effective date of the floodplain management regulations adopted by the municipality.
NJDEP
The New Jersey Department of Environmental Protection.
NJPDES
The New Jersey Pollutant Discharge Elimination System as set forth in N.J.S.A. 58:10A-1 et seq. and in N.J.A.C. 7:14A.
NJPDES PERMIT
A permit issued by the NJDEP pursuant to the authority of the Water Pollution Control Act, N.J.S.A. 58:10A-1 et seq., and N.J.A.C. 7:14A for a discharge of pollutants.
NODE
An area designated by the State Planning Commission concentrating facilities and activities which are not organized in a compact form.
NONCONFORMING BUILDING OR STRUCTURES
A building or structure which in its location upon a lot or in its size, does not conform to the regulations of this ordinance for the zone in which it is located.
NONCONFORMING LOT
A lot of record which does not have the minimum size, width, frontage or depth or contain the minimum area for the zone in which it is located.
NONCONFORMING USE
A use occupying a building, structure or lot which does not conform with the use regulations for the zone in which it is located.
NONEXEMPT SALE
Any sale or transfer of ownership other than the transfer of ownership between husband and wife; the transfer of ownership between former spouses ordered as a result of a judicial decree of divorce or judicial separation, but not including sales to third parties; the transfer of ownership between family members as a result of inheritance; the transfer of ownership through an executor's deed to a Class A beneficiary and the transfer of ownership by court order.
NON-POINT SOURCE
1. Any human-made or human-induced activity, factor, or condition, other than a point source, from which pollutants are or may be discharged;

2. Any human-made or human-induced activity, factor, or condition, other than a point source, that may temporarily or permanently change any chemical, physical, biological, or radiological characteristic of waters of the state from what was or is the natural, pristine condition of such waters, or that may increase the degree of such change; or

3. Any activity, factor, or condition, other than a point source, that contributes or may contribute to water pollution.

4. The term "NPS" shall have the same meaning as "non-point source."
NONSTRUCTURAL BMP
A stormwater management measure, strategy or combination of strategies that reduces adverse stormwater runoff impacts through sound site planning and design. Nonstructural BMPs include such practices as minimizing site disturbance, preserving important site features, reducing and disconnecting impervious cover, flattening slopes, utilizing native vegetation, minimizing turf grass lawns, maintaining natural drainage features and characteristics and controlling stormwater runoff and pollutants closer to the source. The term "low-impact development technique" shall have the same meaning as "nonstructural BMP."
NURSING CARE UNIT
A bed in a nursing facility that is licensed by the New Jersey State Department of Health to provide health care under medical supervision and continuous nursing care for 24 or more consecutive hours to patients who do not require the degree of care and treatment which a hospital provides and who, because of their physical and/or mental condition require continuous nursing care and services above the level of room and board. Each bed within a nursing unit shall be a dwelling unit for the purposes of calculating gross density.
NUTRIENT
A chemical element or compound, such as nitrogen or phosphorus, which is essential to and promotes the development of organisms.
NUTRIENT

OFFICE
A place for the transaction of business where reports are prepared, records kept and services rendered, but where no retail sales, except in connection with professional services, are offered and where no manufacturing, assembly or fabricating takes place.
OFFICE COMPLEX (aka "PARK")
Any tract(s) of land that is/are developed and operated as a coordinated and integrated facility, in separate buildings or one building, for a number of separate office uses. These sites often contain shared open space, with consideration for circulation, parking, signage, and utility needs.
OFF-SITE
Located outside the lot lines of the property in question but within the property (of which the lot is a part) which is the subject of a development application, or on a contiguous portion of the street right-of-way.
OFF-TRACT
Not located on the property which is the subject of a development application or on a contiguous portion of a street right-of-way or drainage or utility easement.
O-HORIZON
A surface horizon, occurring above the A-horizon in some soils, which is composed primarily of undecomposed or partially decomposed plant remains which have not been incorporated into the mineral soil.
ON-SITE
Located on the lot in question.
ON-TRACT
Located on the property which is the subject of a development application or on a contiguous portion of a street right-of-way.
OPEN SPACE
Any parcel or land area or water, essentially unimproved and set aside, dedicated, designated or reserved for public or private use or enjoyment, or for the use and enjoyment of owners and occupants of land adjoining or neighboring such open space; provided that such areas may be improved with only those buildings, structures, streets, off-street parking and other improvements that are designed to be incidental to the natural openness of the land, and provided further that no portion of the required open space shall include any yard or setback distance stipulated in this ordinance and any street right-of-way.
PAPER
All newspaper, fine paper, bond paper, junk mail, office paper, magazines, paperback books, school paper, catalogs, computer paper, telephone books and similar cellulosic material, whether shredded or whole, but excluding tissue and towel paper, wax paper, plastic or foil-coated paper, thermal fax paper, carbon paper, NCR paper, blueprint paper, food-contaminated or soiled paper.
PARCEL
Any quantity of land consisting of one or more lots, that is capable of being described with such definiteness that its location and boundaries may be established.
PARKING SPACE
Any area, either within a structure or in the open, of not less than nine feet wide by 20 feet in length, or, in the case of a handicapped parking space, an area not less than eight feet wide by 20 feet in length with an adjacent access aisle at least five feet wide, for the parking of motor vehicles, exclusive of driveways, access drives, fire lanes and public rights-of-way, except that the length of a parking space may be reduced to 18 feet in length, subject to the approval of the Board in those instances where a two-foot overhang area exists beyond a curb and where such overhang does not interfere with any proposed and/or required landscaping. Notwithstanding any other provision of this ordinance, nothing shall prohibit private driveways for detached dwelling units from being considered off-street parking areas, except that no portion of such private driveway within the right-of-way line of the street intersected by such driveway shall be considered off-street parking areas. The width and length of each space shall be measured perpendicular to each other regardless of the angle of the parking space to the access aisle or driveway.
 
PERCHED ZONE OF SATURATION
A zone of saturation which occurs immediately above a hydraulically restrictive horizon and which is underlain by permeable horizons or substrata which are not permanently or seasonally saturated.
PERFORMANCE GUARANTEE
Any security, in accordance with the requirements of this ordinance, which may be accepted in lieu of a requirement that certain improvements be completed prior to final approval of a development application, including performance bonds, escrow agreements and other similar collateral or surety agreements.
PERMEABILITY
The rate at which water moves through a unit area of soil, rock, or other material at a hydraulic gradient of one.
PERMEABILITY
The rate at which water moves through a saturated unit area of soil or rock material at a hydraulic gradient of one, determined as prescribed in N.J.A.C. 7:9A-6.2 (tube permeameter test), N.J.A.C. 6.5 (pit bailing test) or N.J.A.C. 6.6 (piezometer test). Alternative permeability test procedures may be accepted by the approving authority, provided the test procedure attains saturation of surrounding soils, accounts for hydraulic head effects on infiltration rates, provides a permeability rate with units expressed in inches per hour and is accompanied by a published source reference. Examples of suitable sources include hydrogeology, geotechnical, or engineering text and design manuals, proceedings of American Society for Testing and Materials (ASTM) symposia, or peer-review journals. Neither a soil permeability class rating test, as described in N.J.A.C. 7:9A-6.3, nor a percolation test, as described in N.J.A.C. 7:9A-6.4, is an acceptable test for establishing permeability values for the purpose of complying with this section.
PERMEABLE
Having a permeability of one inch per hour or faster. The terms "permeable soil," "permeable rock" and "permeable fill" shall be construed accordingly.
PERMITTED USE
Any use of land or buildings as permitted by this ordinance.
PERSON
An individual, corporation, public agency, business trust, partnership, association, two or more persons having a joint or common interest or any other legal entity.
PERSON
Any individual, firm, partnership, corporation, association, cooperative enterprise, trust, municipal authority, federal institution or agency, state institution or agency, municipality, other governmental agency of any other entity or any group of such persons, which is recognized by law as the subject of rights and duties.
PERSON
Any individual, corporation, company, partnership, firm, association, political subdivision of this state and any state, interstate or federal agency.
PERSON WITH HEAD INJURY
A person who has sustained an injury, illness or traumatic changes to the skull, the brain contents or its coverings which results in a temporary or permanent physiobiological decrease of mental, cognitive, behavioral, social or physical functioning which causes partial or total disability.
PIEZOMETER
A device consisting of a length of metal or plastic pipe, open at the bottom or perforated within a specified interval, and used for the determination of depth to water, permeability or hydraulic head within a specific soil horizon or substratum.
PINELANDS
The Pinelands National Reserve and the Pinelands Area.
PINELANDS AREA
That area designated as such by N.J.S.A. 13:18A-11a of the Pinelands Protection Act.
PINELANDS CMP
The New Jersey Pinelands Comprehensive Management Plan (N.J.A.C. 7:50 1.1 et seq.).
PINELANDS COMMISSION or COMMISSION
The Commission created pursuant to § 5 of the Pinelands Protection Act, N.J.S.A. 13:18A-5.
PINELANDS DEVELOPMENT CREDITS
A use right allocated to certain lands within the Township pursuant to N.J.A.C. 7:50-5.43 that can be used to secure a residential density bonus on other lands within the Township or in other municipalities which have Pinelands regional growth areas.
PINELANDS FIRE HAZARD
The classification of a parcel of land in accordance with the provisions of N.J.A.C. 7:50-6.123 of the Pinelands Comprehensive Management Plan.
PINELANDS NATIONAL RESERVE
That area designated as such by N.J.S.A. 13:18A-3i of the Pinelands Protection Act.
PINELANDS NATIVE FOREST TYPE

PINELANDS PRESERVATION AREA
That area so designated by N.J.S.A. 13:18A-11b of the Pinelands Protection Act.
PINELANDS PROTECTION ACT
N.J.S.A. 13:18A-1 to 18A-29.
PINELANDS PROTECTION AREA
All land within the Pinelands Area not included in the Pinelands Preservation Area.
PINELANDS RESOURCE-RELATED USE
Any use which is based on resources which are indigenous to the Pinelands including, but not limited to, forest products, berry agriculture and sand, gravel, clay or ilmenite.
PLANNED DEVELOPMENTS
RESIDENTIAL CLUSTER — An area to be developed as a single entity according to a plan containing residential housing units which have a common or public open space area as an appurtenance; i.e., a residential development in which dwellings are grouped closer to each other than would otherwise be permitted, and in which the open space so saved remains an integral element of the development.
 
EASTTOWN PLANNED DEVELOPMENT — An area to be developed as a single entity according to a plan, containing and integrating residential dwelling units and commercial uses along with a number of appurtenant public and quasi-public uses and areas in such ranges or ratios as specified in this ordinance, and in a manner to create a community offering a broad range of housing types including a set-aside of below market cost housing units, employment opportunities, basic services and shopping for residents as well as for those residents in the surrounding areas of the Township; all accomplished according to a planning design reflecting the character of historical small towns and villages in New Jersey, especially Medford Village.
 
SENIOR CITIZEN PLANNED DEVELOPMENT — An area to be developed with a mixture of single family detached dwellings, a retail commercial shopping center, and housing for senior citizens, including a set-aside of below market cost housing units and an Assisted Care Facility for the senior citizens.
PLANTS, THREATENED OR ENDANGERED
A Pinelands plant species whose survival worldwide, nationwide, or in the state is in jeopardy.
PLATY STRUCTURE
Is characterized by a soil aggregate which has one axis distinctly shorter than the other two and is oriented with the short axis vertical.
POINT SOURCE
Any discernible, confined, and discrete conveyance, including, but not limited to, any pipe, ditch, channel, tunnel, conduit, well, discrete fissure, container, rolling stock, concentrated animal feeding operation, landfill leachate collection system, vessel, or other floating craft, from which pollutants are or may be discharged. This term does not include return flows from irrigated agriculture.
POLLUTANT
Any dredged spoil, solid waste, incinerator residue, filter backwash, sewage, garbage, refuse, oil, grease, sewage sludge, munitions, chemical wastes, biological materials, medical wastes, radioactive substances [except those regulated under the Atomic Energy Act of 1954, as amended (42 U.S.C. § 2011 et seq.)], thermal waste, wrecked or discarded equipment, rock, sand, suspended solids, cellar dirt, industrial, municipal, agricultural, and construction waste or runoff, or other residue discharged directly or indirectly to the land, groundwaters or surface waters of the state or to a domestic treatment works. "Pollutant" includes both hazardous and nonhazardous pollutants.
POLLUTANT
Any dredged spoil, solid waste, incinerator residue, filter backwash, sewage, garbage, refuse, oil, grease, sewage sludge, munitions, chemical wastes, biological materials, medical wastes, radioactive substance [except those regulated under the Atomic Energy Act of 1954, as amended (42 U.S.C. § 2011 et seq.)], thermal waste, wrecked or discarded equipment, rock, sand, cellar dirt, industrial, municipal, agricultural, and construction waste or runoff, or other residue discharged directly or indirectly to the land, groundwaters or surface waters of the state, or to a domestic treatment works. "Pollutant" includes both hazardous and nonhazardous pollutants.
PORCH
A roofed, open structure projecting from the front, side or rear wall of a building and having no enclosed features of glass, wood or other material more than 30 inches above the floor thereof, except the necessary columns to support the roof. A "porch" may be screened.
PRESENT NEED
An estimate of low- and moderate-income households living in substandard housing as calculated through the use of census surrogates.
PRINCIPAL USE
The primary purpose for which a lot or building is used.
PRIOR ROUND HOUSING OBLIGATION
The 1987-1999 fair share based on N.J.A.C. 5:93-1.
PROFESSIONAL ENGINEER
A person licensed to practice professional engineering in the State of New Jersey pursuant to N.J.S.A. 48:8-27 et seq.
PUBLIC AGENCIES
The government of the United States of America, the State of New Jersey or any other state; their political subdivisions, agencies or instrumentalities; and interstate and regional agencies exercising sovereign powers of government.
PUBLIC PURPOSE USES
The use of land or buildings by the governing body of Medford Township or any officially created authority or agency thereof.
PUBLIC SERVICE INFRASTRUCTURE
Sewer service, gas, electricity, water, telephone, cable television and other public utilities developed linearly, roads and streets and other similar services provided or maintained by any public or private entity.
PUBLIC SERVICES
Sewer service, gas, electricity, water, telephone, television and other similar services provided or maintained by any public or private entity.
QUALIFIED PRIVATE COMMUNITY
A residential condominium, cooperative or fee simple community or horizontal property regime, the residents of which do not receive any tax abatement or tax exemption related to its construction comprised of a community trust or other trust device, condominium association, homeowners' association or council of co-owners, wherein the cost of maintaining roads and streets and providing essential services is paid for by a not-for-profit entity consisting exclusively of unit owners within the community. No apartment building or garden apartment complex owned by an individual or entity that receives monthly rental payments from tenants who occupy the premises shall be considered a qualified private community. No "proprietary campground facility," as defined in Section 1 of P.L. 1993, c. 258 (N.J.S.A. 45:22A-49), shall be considered to be a qualified private community.
RANDOM SELECTION PROCESS
A process by which currently income-eligible households are selected for placement in affordable housing units such that no preference is given to one applicant over another except for purposes of matching household income and size with an appropriately priced and sized affordable unit (e.g., by lottery).
RECHARGE
The amount of water from precipitation that infiltrates into the ground and is not evapotranspired.

RECOMMENDED MANAGEMENT PRACTICE
The management program which employs the most efficient use of available technology and natural, human and economic resources.
RECORD TREE
The largest tree of a particular species in New Jersey based on its circumference at 4.5 feet above ground level. A listing of the largest known tree of each species and its location is maintained at the principal offices of the Commission.
RECREATION AREAS
Any lots wholly or partially set aside for passive or active recreation that exist within the development at the time of major or minor subdivision approval, or are proposed as part of the development itself.
RECREATION, ACTIVE
Intensive recreation, including facilities for physical activities, games, team sports and generally any recreation that is not passive or low intensive.
RECREATION, PASSIVE OR LOW INTENSIVE
Recreation with insignificant impact on surrounding areas or on the environmental integrity of the area, including, but not limited to, hiking, running, hunting, trapping, fishing, canoeing, nature study and bicycling or cultural and performance arts-type activities.
RECREATIONAL FACILITY, INTENSIVE
Any recreational facility which is not a low intensive recreational facility, including but not limited to golf courses, marinas, amusement parks, hotels and motels.
RECREATIONAL FACILITY, LOW INTENSIVE
A facility or area which complies with the standards of N.J.A.C. 7:50-5, Part II, utilizes and depends on the natural environment of the Pinelands and requires no significant modifications of that environment other than to provide access, and which has an insignificant impact on surrounding uses or on the environmental integrity of the area. It permits such low intensity uses as hiking, hunting, trapping, fishing, canoeing, nature study, orienteering, horseback riding and bicycling.
RECREATIONAL VEHICLE
A vehicle which is:

1. Built on a single chassis;

2. Four hundred square feet or less when measured at the longest horizontal projections;

3. Designed to be self-propelled or permanently towable by a light-duty truck; and

4. Designed primarily not for use as a permanent dwelling but as temporary living quarters for recreational, camping, travel, or seasonal use.
RECYCLABLE MATERIALS
Materials that would otherwise become solid waste that can be separated, collected and/or processed and returned to the economic mainstream in the form of raw materials or products.
RECYCLING
Any process by which materials, which would otherwise become solid waste, are collected, separated or processed and returned to the economic mainstream in the form of raw materials or products.
REDEVELOPMENT
Construction on previously developed land; typically includes the demolition of existing structures or site improvements, or the renovation of existing development.
REGIONAL ASSET LIMIT
The maximum housing value in each housing region affordable to a four-person household with an income at 80% of the regional median as defined by adopted/approved regional income limits published annually by COAH or a successor entity as approved by the Superior Court.
REGIONAL ZONE OF SATURATION
A zone of saturation which extends vertically without interruption below the depth of soil borings and profile pits.
REGULATED IMPERVIOUS SURFACE
Any of the following, alone or in combination:

1. A net increase of impervious surface;

2. The total area of impervious surface collected by a new stormwater conveyance system (for the purpose of this definition, a "new stormwater conveyance system" is a stormwater conveyance system that is constructed where one did not exist immediately prior to its construction or an existing system for which a new discharge location is created);

3. The total area of impervious surface proposed to be newly collected by an existing stormwater conveyance system; and/or

4. The total area of impervious surface collected by an existing stormwater conveyance system where the capacity of that conveyance system is increased.
REGULATED MOTOR VEHICLE SURFACE
Any of the following, alone or in combination:

1. The total area of motor vehicle surface that is currently receiving water;

2. A net increase in motor vehicle surface; and/or quality treatment either by vegetation or soil, by an existing stormwater management measure, or by treatment at a wastewater treatment plant, where the water quality treatment will be modified or removed.
REHABILITATION
The repair, renovation, alteration or reconstruction of any building or structure, pursuant to the Rehabilitation Subcode, N.J.A.C. 5:23-6.
REHABILITATION
The process of returning a property to a state of utility through repair or alteration, making possible an efficient current use while preserving those features of the property which are significant to its historic, architectural and cultural traditions.
RENT
The gross monthly cost of a rental unit to the tenant, including the rent paid to the landlord, as well as an allowance for tenant-paid utilities computed in accordance with allowances published by DCA for its Section 8 program. In assisted living residences, rent does not include charges for food and services.
REPAIR
Any work done on any improvement(s) which:

1. Is not an addition to that improvement; and

2. Does not change the appearance of the exterior surface of any improvement.
REPLACEMENT
Repairs, when a construction permit is required for same.
REPLICATE
One of two or more soil samples or tests taken at the same location (within five feet of each other) and depth, within the same soil horizon or substratum. In the case of fill material, replicate tests are tests performed on subsamples of the same bulk sample packed to the same bulk density.
RESIDENT
Any person residing within the municipality on a temporary or permanent basis, but excluding persons residing in hotels or motels.
RESOURCE CONSERVATION PLAN
A plan prepared for review by the Soil Conservation District, which details the proposed use of agricultural recommended management practices.
RESOURCE EXTRACTION
The dredging, digging, extraction, mining and quarrying of sand, gravel clay, or ilmenite for commercial purposes, not including, however, the private or agricultural extraction and use of extracted material by a landowner.
RESOURCE MANAGEMENT SYSTEM PLAN
A plan, prepared in accordance with the United States Department of Agriculture, Natural Resources Conservation Service, New Jersey Field Office Technical Guide, dated June 2005. Such plans shall prescribe needed land treatment and related conservation and natural resources management measures, including forest management practices, for the conservation, protection and development of natural resources, the maintenance and enhancement of agricultural or horticultural productivity, and the control and prevention of non-point-source pollution; and establish criteria for resource sustainability of soil, water, air, plants and animals.
RESTAURANT
Any establishment, however designated, at which food is sold primarily for consumption on the premises. However, a snack bar or refreshment stand at a public or community swimming pool, playground, playfield or park, operated solely by the agency or group operating the recreational facility and for the convenience of patrons of the facility, shall not be deemed a restaurant.
RESTAURANT, FAST-FOOD
A commercial establishment where foods and drink, prepared for immediate consumption, are purchased at a counter and either eaten on the premises, in the purchaser's automobile, or off the premises. Those restaurants where a majority of prepared food is consumed only at tables on the premises and served by waiters or waitresses at said tables shall not be deemed "fast-food restaurants." Any restaurant with drive-through window service shall be considered a "fast-food restaurant." "Fast-food restaurants" shall not include those retail stores where food is primarily sold for preparation and consumption elsewhere, such as a supermarket, or stores where, as a secondary use of the premises, prepared foods may also be sold over the counter for immediate consumption, such as a delicatessen.
RESTRICTED UNIT
A dwelling unit, whether a rental unit or an ownership unit, that is subject to the affordability controls of N.J.A.C. 5:80-26.1, as may be amended and supplemented, but does not include a market-rate unit financed under UHORP or MONI.
ROOFLINE
The point of intersection between a sloped roof and a perimeter wall of the structure or the eave. Where roofs are flat, the uppermost point of a facade or parapet is the roofline.
ROOT RAKING
A silvicultural practice involving the drawing of a set of tines, mounted on the front or trailed behind a tractor, over an area to thoroughly disturb tree and vegetation roots and/or to collect stumps and slash.
RUNWAY END SUBZONE
The Runway End Subzones of an Airport Hazard Area shall consist of trapezoids located at either end of the Runway Subzone along the flight approach and departure path. Each Runway End Subzone shall extend 3,000 feet from the end of the Runway Subzone, as measured along the extended centerline of the runway. The base of the Runway End Subzone shall be defined by the end of the Runway Subzone, and shall have a width of 2,350 feet. The width of the Runway End Subzone shall narrow as the distance from the end of the Runway Subzone increases. Its final width shall be 850 feet.
RUNWAY LENGTH AND WIDTH
The dimensioned area usable for the landing or takeoff of aircraft. It may be paved, unpaved, or water. Along their length, runways are required to have a minimum sighting distance between points 1.5 meters [five feet] high for all distances separated by 350 meters [1,148 feet].
RUNWAY SAFETY AREA
An area in which a runway is symmetrically located and is graded to be smooth and level. These areas are to be maintained in such a condition that aircraft operating thereon may do so safely and with no damage.
RUNWAY SUBZONE
The Runway Subzone of an Airport Hazard Area shall consist of a rectangle having the same centerline and length as the runway, unless a shorter length is necessitated by limited property ownership at the airport. The width of the Runway Subzone shall be 2,350 feet and the length of the Runway Subzone shall be the same as the physical length of the runway.
SAND
A particle size category consisting of mineral particles which are between 0.05 and 2.0 millimeters in equivalent spherical diameter; also, a soil textural class having 85% or more of sand and a content of silt and clay such that the percentage of silt plus 1.5 times the percentage of clay does not exceed 15, as shown in Subsection K.3.a (USDA Soil Textural Triangle).
SANDY CLAY
A soil textural class having 35% or more of clay and 45% or more of sand, as shown in Subsection K.3.a (USDA Soil Textural Triangle).
SANDY LOAM
A soil textural class, as shown in Subsection K.3.a (USDA Soil Textural Triangle), that has a maximum of 20% clay, and the percentage of silt plus twice the percentage of clay exceeds 30, and contains 52% or more sand; or less than 7% clay, less than 50% silt, and between 43% and 52% sand.
SATELLITE DISH ANTENNA
Any apparatus or structure constructed or installed out of doors with the purpose of receiving television, radio or similar waves, but excluding, however, conventional television antennas.
SEASONAL HIGH-WATER TABLE
The level below the natural surface of the ground to which water seasonally rises in the soil in most years.
SEASONALLY HIGH WATER TABLE
The upper limit of the shallowest zone of saturation which occurs in the soil, identified as prescribed in N.J.A.C. 7:9A-5.8.
SEDIMENT
Solid material, mineral or organic, that is in suspension, is being transported, or has been moved from its site of origin by air, water or gravity as a product of erosion.
SEED TREE CUT
A silvicultural practice involving the removal of old forest stand in one cutting, except for a small number of trees left singly, in small groups or narrow strips, as a source of seed for natural regeneration.
SERVICE STATION
Any building, land area or other premises, or portion thereof, used or intended to be used for the retail dispensing or sales of vehicular fuels; and including as an accessory use the sale and installation of lubricants, tires, batteries and similar accessories as well as the performance of minor repair services, but where no vehicular painting and/or bodywork is done and where no junked or unregistered motor vehicles are kept or stored.
SETBACK LINE
A line drawn parallel or concentric to a street line or lot line and drawn through the point of the building nearest to the street line or lot line. The term "required setback" means a line that is established a minimum horizontal distance from the street line or lot line and beyond which a building or part of a building is not permitted to extend toward the street line or lot line. The minimum front, side and rear yard requirements specified in this ordinance shall be the minimum "required setbacks."
 
 
SHELTERWOOD CUT
A silvicultural practice involving the establishment of a new, essentially even-aged forest stand from release, typically in a series of cuttings, of new trees started under the old forest stand. A shelterwood cut involves the establishment of the new forest stand before the old forest stand is removed.
SHOPPING CENTER
Any tract(s) of land that is/are developed and managed as a total entity, in separate buildings or one building, for a number of separate retail sales and service uses. These sites often contain shared open space, with consideration for circulation, parking, loading, signage, and utility needs.
SIGHT TRIANGLE EASEMENT AT INTERSECTION
A triangular area established in accordance with the requirements of this ordinance in which no grading, planting or structure shall be erected or maintained more than 12 inches above the street centerline except for street signs, fire hydrants and light standards.
SIGN
Any message written, printed, painted or otherwise, placed on a board, plate, banner, or upon any material or object, and/or any device whatsoever, which by reason of its form, color, wording, activity, technique or otherwise, attracts attention to itself, whether used as a means of identification, advertisement or announcement. In addition to the provisions of this ordinance, all signs shall comply with the provisions of the Uniform Construction Code.
SIGN
Any object, device, display or structure, or part thereof, situated outdoors or indoors, which is used to advertise, identify, display, direct or attract attention to an object, person, institution, organization, business, product, service, event or location by any means, including words, letters, figures, designs, symbols, fixtures, colors, illumination or projected images.
SIGN FACE
The area or display surface used to convey the message.
SIGN, ANIMATED, INFLATABLE OR MOVING
Any sign or part of a sign which changes physical position by any movement or rotation or which gives the visual illusion of motion or rotation. These signs include devices motivated by environmental change, such as wind; mechanically activated or expanded, such as electric power, air or gas; electrically animated, such as electronic; flashing, such as a repetitive cycle of illumination and nonillumination; and patterned illusory movement, such as alternating or sequential illumination. Changeable-copy signs are not defined as animated or moving signs.
SIGN, AWNING
A sign mounted to, painted on, or attached flat against the surface or surfaces of an awning.
SIGN, BENCH
A sign painted on, mounted on or attached to any part of the surface of a bench, seat, or chair placed on or adjacent to a public place or roadway.
SIGN, BILLBOARD (aka OFF-PREMISES SIGN)
A sign which contains a commercial message and which directs attention to a business, commodity, service or entertainment conducted, sold or offered at a location other than the premises on which the sign is located. When the product or service advertised is incidental to the principal activity and when the sign brings compensation to the owner of the sign, the sign shall be considered an off-premises sign used for the purpose of outdoor advertising.
SIGN, BUS SHELTER
A sign affixed to the surface of a bus shelter, which contains a message and which directs attention to a cause, agency, business, commodity, public information, service or entertainment conducted, sold, or offered at a location other than the premises on which the sign is located.
SIGN, CANOPY
A sign that is mounted to, painted on, or attached flat against the surfaces of a canopy that is otherwise permitted.
SIGN, CHANGEABLE-COPY
A sign designed so that characters, letters, or illustrations can be changed or rearranged without altering the face of or the surface of the sign by either manual or electronic means.
SIGN, COMMUNITY INFORMATION
A sign which contains messages of schools, civic groups, places of worship, veterans' groups or a similar use which is operated not for profit and local special events, which directs attention to a place of worship, nonprofit, facility, event, club, or organization.
SIGN, CONSTRUCTION
A temporary sign erected on the premises on which construction is taking place, during the period of such construction, indicating the names of architects, engineers, landscape architects, contractors, or similar artisans, and the owners, financial supporters, sponsors, and similar individuals, or firms having a role or interest with respect to the structure or project.
SIGN, CONTRACTOR
A sign located on site which advertises the trade name or business name of any mechanic, contractor, or artisan performing work on the premises where the sign is placed.
SIGN, DEVELOPER
A sign located on site or off premises identifying or directing traffic to a particular site or development.
SIGN, DIRECTIONAL AND INFORMATIONAL
Signs limited to directional messages for public service, principally for pedestrian or vehicular traffic, such as "restroom," "one-way," "entrance," and "exit." Window signs, such as those that indicate hours of operation, credit card acceptance, and business affiliations, are considered as informational signs.
SIGN, ELECTION
Any sign erected for the purpose of endorsing political candidate(s) for elected office in any national, state or local election or advocating a recommendation with respect to a public referendum question on an election ballot.
SIGN, FACADE OR FASCIA
See "sign, wall."
SIGN, FREE EXPRESSION
Any sign announcing, publicizing or communicating an opinion, principle, movement, political viewpoint or any other noncommercial message.
SIGN, FREESTANDING
Any immovable sign supported by columns, posts, poles, footings, or braces placed in or upon the ground and not affixed to a building.
SIGN, HOLIDAY DECORATION
Temporary signs, in the nature of decorations, clearly incidental to and customarily and commonly associated with any national, local, or religious holiday or observance.
SIGN, HOME OCCUPATION
A sign containing the name, trademark, trade name, logo, and/or occupation or profession of a permitted home occupation as defined in § 203 and conditionally permitted in § 602.F.
SIGN, IDENTIFICATION
A sign giving the nature, logo, trademark or other identifying symbol; address; or any combination of the name, symbol and address, of a building, business, development, or establishment on the premises where it is located.
SIGN, ILLUMINATED
A sign lighted by or exposed to artificial lighting, either by lights projecting through the surface(s) (internally illuminated) of the sign or reflected off the front or rear surface(s) (externally illuminated or reverse-channel backlit letters) of the sign.
SIGN, MEMORIAL OR NAMEPLATE
Memorial signs or tablets, name(s) of building(s) and date of erection when cut into any masonry surface, integral to the construction of a building, or when constructed of bronze or other incombustible material mounted on the face of a building, bench or other structure.
SIGN, MOBILE
Any sign designed to be transported, including signs transported or mounted on a trailer or wheels that do not contain any interior volume for storage or transportation.
SIGN, MONUMENT (aka GROUND or PEDESTAL)
A type of freestanding sign in contact with a base or monument, which appears to be in contact with the ground, utilizing plant or constructed materials or actual ground contact to achieve this effect.
SIGN, MULTIPLE-OCCUPANCY and TENANCY SIGN
On-premises sign(s) identifying professions, trade names, or tenants, occupants, or owners of multi-tenant commercial or industrial buildings or groups of buildings.
SIGN, NEIGHBORHOOD IDENTIFICATION
A sign located on premises or at a public entrance indentifying any type of residential development by name. No advertising for real estate agents, developers, contractors, builders, architects or other is permitted on neighborhood identification signs.
SIGN, NONCONFORMING
Any sign that does not conform to the regulations of this section.
SIGN, OFFICIAL
Any sign erected, constructed, or maintained by a government entity or agency for the purpose of informing or guiding the public.
SIGN, OFF-PREMISES
See "sign, billboard."
SIGN, POLITICAL OR PERSONAL OPINION
Any sign announcing or publicizing political candidates or issues in connection with any national, state or local election; any sign announcing or publicizing a topical principle or movement.
SIGN, PORTABLE
A sign not permanently attached to a building, building surface, structure or the ground.
SIGN, POST AND GIBBET
A sign suspended from a post and gibbet structure.
SIGN, PROJECTION
A sign that is wholly or partly dependent upon a building for support and which projects perpendicularly from the building face.

 
SIGN, PUBLIC UTILITY, TELECOMMUNICATIONS, OR ALTERNATIVE ENERGY
A sign located on a premises, structure or facility providing information, identification or warning for a public utility, telecommunications, or alternative energy use or location.
SIGN, REAL ESTATE
A sign pertaining to the sale, lease, or rental of the property or premises, or a portion of the property or premises, on which the sign is located.
SIGN, ROOF
A sign mounted on or above the roofline, as defined, of a building. This is a sign that projects above the top wall or edge of a building with a flat roof, above the eave line or roof line of a building with a gambrel, gable, or hip roof, or above the deckline of a building with a mansard roof.
SIGN, SPECIAL EVENT
(See "sign, temporary.")
SIGN, SUSPENDED
Any sign hanging down from a marquee, awning, canopy, porch, or roof overhang that would exist without the sign.

 
SIGN, TEMPORARY
A sign constructed of paper, cloth, canvas, plastic, plywood, or other lightweight material intended to display either commercial or noncommercial messages of a transitory or temporary nature.
SIGN, TIME-AND-TEMPERATURE
Any sign or portion of a sign located on premises, displaying the time and/or temperature.
SIGN, TRAILER
A sign designed to be transported and affixed either temporarily or permanently on any registered trailer typically used in the course of business for deliveries and transport of services, goods, persons, or materials.
SIGN, VEHICLE
A sign affixed or painted on a vehicle or trailer.
SIGN, WALL
A sign fastened to or painted on the wall of a building or structure in such a manner that the wall becomes the supporting structure for, or forms the background surface of, the sign.
SIGN, WARNING
A sign making an announcement or admonition such as but not limited to "beware of dog," "private property," "no trespassing," "no hunting," or advising the public of the use of chemicals, herbicides or pesticides.
SIGN, WINDOW
A sign applied to or attached to the exterior or interior of a window. Window signs are visible from outside the building and are placed with the sole intent to attract customers from outside.
SILT
A particle size category consisting of mineral particles which are between 0.002 and 0.05 millimeter in equivalent spherical diameter. It also means a soil textural class having 80% or more of silt and 12% or less of clay, as shown in Subsection K.3.a (USDA Soil Textural Triangle).
SILT LOAM
A soil textural class having 50% or more of silt and 12% to 27% of clay; or 50% to 80% of silt and less than 12% of clay, as shown in Subsection K.3.a (USDA Soil Textural Triangle).
SILTY CLAY
A soil textural class having 40% or more of clay and 40% or more of silt, as shown in Subsection K.3.a (USDA Soil Textural Triangle).
SILTY CLAY LOAM
A soil textural class having 27% to 40% of clay and less than 20% of sand, as shown in Subsection K.3.a (USDA Soil Textural Triangle).
SITE
The lot or lots upon which a major development is to occur or has occurred.
SITE PLAN
A development plan of one or more lots on which is shown (1) the existing and proposed conditions of the lot, including but not limited to topography, vegetation, drainage, floodplains, marshes and waterways; (2) the location of all existing and proposed buildings, drives, parking spaces, walkways, means of ingress and egress, drainage facilities, utility services, landscaping, structures and signs, lighting, screening devices; and (3) any other information that may be reasonably required in order to make an informed determination concerning the adequacy of the plan in accordance with the requirements of this ordinance.
 
MINOR SITE PLAN — Any site plan for any new development or building alteration or addition not exempt from site plan review which involves grading, clearing or disturbance of an area less than 5,000 square feet.
 
MAJOR SITE PLAN — Any site plan not defined as a minor site plan.
SITE PLAN REVIEW
The examination of the specific development plans for a lot or tract of land. Whenever the term "Site Plan Approval" is used in this ordinance, it shall be understood to mean a requirement that the site plan be reviewed and approved by the Board in accordance with the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.).
SOIL
All unconsolidated mineral and organic material of any origin which is not a rock substratum, including sediments below the biologically active and/or weathered zones.
SOIL
All unconsolidated mineral and organic material of any origin.
SOIL AGGREGATE
A naturally occurring unit of soil structure consisting of particles of sand, silt, clay, organic matter, and coarse fragments held together by the natural cohesion of the soil.
SOIL COLOR
The soil color name and Munsell color designation determined by comparison of the moist soil with color chips contained in a Munsell soil color book.
SOIL CONSISTENCE
The resistance of a soil aggregate or clod to being crushed between the fingers or broken by the hands. Terms for describing soil consistence described are in N.J.A.C. 7:9A-5.3(h).
SOIL HORIZON
A layer within a soil profile differing from layers of soil above and below it in one or more of the soil morphological characteristics, including color, texture, coarse fragment content, structure, consistence and mottling.
SOIL LOG
A description of the soil profile which includes the depth, thickness, color, texture, coarse fragment content, mottling, structure and consistence of each soil horizon or substratum.
SOIL MAPPING UNIT
An area outlined on a map in a County Soil Survey Report and marked with a letter symbol designating a soil phase, a complex of two or more soil phases, or some other descriptive term where no soil type has been identified.
SOIL PHASE
A specific type of soil which is mapped by the Natural Resources Conservation Service and which belongs to a soil series described within the County Soil Survey Report.
SOIL PROFILE
A vertical cross section of undisturbed soil showing the characteristic horizontal layers or horizons of the soil which have formed as a result of the combined effects of parent material, topography, climate, biological activity and time.
SOIL SERIES
A grouping of soil types possessing a specific range of soil profile characteristics which are described within the County Soil Survey Report. Each soil series may consist of several "soil phases" which may differ in slope, texture of the surface horizon or stoniness.
SOIL STRUCTURAL CLASS
One of the shape classes of soil structure described in N.J.A.C. 7:9A-5.3(g).
SOIL STRUCTURE
The naturally occurring arrangement, within a soil horizon, of sand, silt and clay particles, coarse fragments and organic matter, which are held together in clusters or aggregates of similar shape and size.
SOIL TEST PIT
An excavation made for the purpose of exposing a soil profile which is to be described.
SOIL TEXTURAL CLASS
One of the classes of soil texture defined within the USDA system of classification (Soil Survey Manual, Agricultural Handbook No. 18, USDA Soil Conservation Service, 1962).
SOIL TEXTURE
The relative proportions of sand, silt and clay in that portion of the soil which passes through a sieve with two-millimeter openings.
SOLAR ENERGY FACILITY
A solar energy system and all associated components, including, but not limited to, panels, arrays, footings, supports, mounting and stabilization devices, inverters, electrical distribution wires and other on-site or off-site infrastructure necessary for the facility, which converts solar energy into usable electrical energy, heats water or produces hot air or other similar function.
SOLID WASTE
Garbage, refuse and other discarded materials, as defined in N.J.S.A. 13:1E-1 et seq. and N.J.S.A. 48:13A-1 et seq.
SOLID WASTE TRANSFER STATION
A facility at which solid waste is transferred from collection vehicles to haulage vehicles for transportation to a landfill.
SOURCE MATERIAL
Any material(s) or machinery, located at an industrial facility, that is directly or indirectly related to processing, manufacturing or other industrial activities, which could be a source of pollutants in any industrial stormwater discharge to groundwater. Source materials include, but are not limited to, raw materials; intermediate products; final products; waste materials; by-products; industrial machinery and fuels; and lubricants, solvents, and detergents that are related to processing, manufacturing, or other industrial activities that are exposed to stormwater.
SOURCE SEPARATED
Recyclable materials separated from the solid waste stream at the point of generation.
SPECIAL MASTER
An expert appointed by a judge to make sure that judicial orders are followed. A master's function is essentially investigative, compiling evidence or documents to inform some future action by the court. "Superior Court" or "the Court" means the Superior Court of New Jersey.
SPECIFIC SEXUAL ACTIVITIES
Human genitals in a state of sexual stimulation or arousal; or acts of human masturbation, sexual intercourse or sodomy; or fondling or other erotic touching of human genitals, the pubic region, buttock(s) or female breast(s).
SPECIFIED ANATOMICAL AREAS
Less than completely and opaquely covered human genitals, pubic region, buttock and/or female breast below a point immediately above the top of the areola; and human male genitals in a discernibly turgid state, even if completely or opaquely covered.
START OF CONSTRUCTION
[For other than new construction or substantial improvements under the Coastal Barrier Resources Act (P.L. No. 97-348)] includes substantial improvements and means the date the building permit was issued, provided the actual start of construction, repair, reconstruction, rehabilitation, addition, placement, or other improvement was within 180 days of the permit date. The "actual start" means either the first placement of permanent construction of a structure on a site such as the pouring of a slab or footings, the installation of pilings, the construction of columns, or any work beyond the stage of excavation, or the placement of a manufactured home on a foundation. Permanent construction does not include land preparation, such as clearing, grading and filling, nor does it include the installation of streets and/or walkways, nor does it include excavation for a basement, footings or piers, or foundations or the erection of temporary forms, nor does it include the installation on the property of accessory buildings, such as garages or sheds not occupied as dwelling units or not part of the main structure. For a substantial improvement, the "actual start of construction" means the first alteration of any wall, ceiling, floor, or other structural part of a building, whether or not that alteration affects the external dimensions of the building.
STATE DEVELOPMENT AND REDEVELOPMENT PLAN METROPOLITAN PLANNING AREA (PA1)
An area delineated on the State Plan Policy Map and adopted by the State Planning Commission that is intended to be the focus for much of the state's future redevelopment and revitalization efforts.
STATE PLAN POLICY MAP
The geographic application of the State Development and Redevelopment Plan's goals and statewide policies, and the official map of these goals and policies.
STATIC WATER LEVEL
The depth below the ground surface, or the elevation with respect to some reference level, of the water level observed within a soil profile pit or boring, or within a piezometer, after this level has stabilized or become relatively constant with the passage of time.
STORMWATER
Water resulting from precipitation (including rain and snow) that runs off the land's surface, is transmitted to the subsurface, or is captured by separate storm sewers or other sewage or drainage facilities, or conveyed by snow removal equipment.

STORMWATER INFILTRATION BMP
A basin or other facility constructed within permeable soils that provides temporary storage of stormwater runoff. An infiltration BMP does not normally have a structural outlet to discharge runoff from the stormwater quality design storm. Instead, outflow from an infiltration BMP is through the surrounding soil. The terms "infiltration measure" and "infiltration practice" shall have the same meaning as "stormwater infiltration basin."
STORMWATER MANAGEMENT BMP
An excavation or embankment and related areas designed to retain stormwater runoff. A stormwater management BMP may either be normally dry (that is, a detention basin or infiltration system), retain water in a permanent pool (a retention basin), or be planted mainly with wetland vegetation (most constructed stormwater wetlands).
STORMWATER MANAGEMENT MEASURE
Any practice, technology, process, program, or other method intended to control or reduce stormwater runoff and associated pollutants, or to induce or control the infiltration or groundwater recharge of stormwater or to eliminate illicit or illegal nonstormwater discharges into stormwater conveyances.
STORMWATER MANAGEMENT MEASURE
Any structural or nonstructural strategy, practice, technology, process, program, or other method intended to control or reduce stormwater runoff and associated pollutants, or to induce or control the infiltration or groundwater recharge of stormwater, or to eliminate illicit or illegal nonstormwater discharges into stormwater conveyances. This includes, but is not limited to, structural and nonstructural stormwater best management practices described in the New Jersey BMP Manual and designed to meet the standards for stormwater control contained within this ordinance. STORMWATER MANAGEMENT PLANNING AGENCY
A public body authorized by legislation to prepare stormwater management plans.
STORMWATER MANAGEMENT PLANNING AREA
The geographic area for which a stormwater management planning agency is authorized to prepare stormwater management plans, or a specific portion of that area identified in a stormwater management plan prepared by that agency.
STORMWATER RUNOFF
Water flow on the surface of the ground or in storm sewers resulting from precipitation.

STORY
That portion of a building included between the surface of any floor and the surface of the next floor above it or, if there be no floor above it, then the surface between the floor and the ceiling next above it. For the purpose of this ordinance, the interior of the roof shall not be considered a ceiling; rather, the underside of the highest horizontal surface separating the area above from the remainder of the structure below shall be considered the ceiling. Moreover, cellars and basements ordinarily shall not be considered stories when considering the height of a building; provided, however, that finished basements in nonresidential buildings shall be considered a story for purposes of height, floor area and parking computations in accordance with the requirements of this ordinance. Finally, a half-story is the area under a pitched roof at the top of a building, the floor of which is at least four feet, but no more than six feet, below the plate; and such half-story shall not be used for nonresidential uses.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive or other way (1) which is an existing state, county or municipal road way or (2) which is shown on a plat heretofore approved, pursuant to law, whether publicly or privately owned, or (3) which is approved by N.J.S.A. 40:55D-1 et seq., or (4) which is shown on a plat duly filed in the office of the County Recording Officer prior to the appointment of a Planning Board and the grant to such Board of the power to review plats; and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulder, gutters, sidewalks, parking areas and other areas within the street line. For purposes of the paving design and setback requirements of this ordinance for and related to streets, all "private roads" shall be considered "streets."
STREET LINE
The edge of the existing or future street right-of-way, whichever may result in the widest right-of-way, as shown on the adopted Master Plan or Official Map, and/or by the applicable requirements of this ordinance, forming the dividing line between the street and a lot.
STRUCTURE
A combination of materials to form a construction for occupancy, use or ornamentation whether installed on, above, or below the surface of a parcel of land (e.g., fences, swimming pools, signs, tennis courts, walls, buildings, etc.) or whether attached to something having a fixed location on, above or below the surface of a parcel of land.
STRUCTURE
A walled and roofed building, a manufactured home, or a gas or liquid storage tank that is principally above ground.
SUBDIVISION
The division of a lot, tract or parcel of land into two or more lots, tracts, parcels, or other divisions of land for sale or development. The following shall not be considered subdivisions within the meaning of this ordinance if no new streets are created: (1) divisions of land found by the Planning Board or subdivision committee thereof to be for agricultural purposes where all resulting parcels are five acres or larger in size, (2) divisions of property by testamentary or intestate provisions, (3) divisions of property upon Court order including, but not limited to, judgements of foreclosure, (4) consolidation of existing lots by deed or other recorded instrument and (5) the conveyance of one or more adjoining lots, tracts or parcels of land, owned by the same person or persons and all of which are found and certified by the Administrative Officer to conform to the requirements of the municipal development regulations and are shown and designated as separate lots, tracts or parcels on the tax map or atlas of the municipality. The term "subdivision" shall also include the term "resubdivision."
 
MINOR SUBDIVISION — Any division of land containing an aggregate of not more than five lots (four new lots and the remaining parcel), each fronting on an existing improved street; provided that such subdivision does not involve: (1) a planned development, (2) any new street, or (3) the extension of any off-tract improvement, the cost of which is to be prorated pursuant to N.J.S.A. 40:55D-42. Any readjustment of lot lines resulting in no new lots shall be classified as a minor subdivision.
 
MAJOR SUBDIVISION — Any subdivision not defined as a minor subdivision.
SUBDIVISION REVIEW
The examination of the specific subdivision plat for a lot or tract of land. Wherever the term "Subdivision Approval" is used in this ordinance, it shall be understood to mean a requirement that the subdivision plat be reviewed and approved by the Board in accordance with the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.).
SUBSTANTIAL DAMAGE
Damage of any origin sustained by a structure whereby the cost of restoring the structure to its condition before damage would equal or exceed 50% of the market value of the structure before the damage occurred.
SUBSTANTIAL IMPROVEMENT
Any reconstruction, rehabilitation, addition, or other improvement of a structure, the cost of which equals 50% of the market value of the structure before the start of construction of the improvement. This term includes structures which have incurred substantial damage, regardless of the actual repair work performed. The term does not, however, include either:

1. Any project for improvement of a structure to correct existing violations of state or local health, sanitary or safety code specifications which have been identified by the local code enforcement officer and which are the minimum necessary to assure safe living conditions; or

2. Any alteration of an historic structure, provided that the alteration will not preclude the structure's continued designation as an historic structure.
SUBSTRATUM
A layer of soil or rock material present below the soil profile and extending beyond the depth of soil borings or profile pits.
SUITABLE SOIL
Unsaturated soil, above the seasonally high water table, which contains less than 50% by volume of coarse fragments and which has a tested permeability rate of between one and 20 inches per hour.
SURFACE WATER
Any waters of the state which are not groundwater.
SWIMMING POOL
A facility constructed above or below the ground, having a depth of more than two feet and/or water surface of 100 square feet or more, and designed and maintained for swimming purposes.
SWMA
The New Jersey Solid Waste Management Act,Editor's Note: See N.J.S.A. 13:1E-1 et seq. as amended.
TAXIWAY
A pathway for movement of an aircraft on the surface, usually connecting the landing and takeoff area or runways with support facilities.
THINNING
A silvicultural practice involving the removal of competing trees to favor certain species, sizes and qualities of trees.
THIRD ROUND HOUSING OBLIGATION
The 1999 — 2025 housing obligation as determined by the Superior Court.
THRESHOLD
A line, at right angles to the runway centerline and extending for the full width of the runway, established for the purpose of identifying the beginning of the runway area that is designated for the landing of airplanes.
TIDAL FLOOD HAZARD AREA
A flood hazard area in which the flood elevation resulting from the two-, ten-, or 100-year storm, as applicable, is governed by tidal flooding from the Atlantic Ocean. Flooding in a tidal flood hazard area may be contributed to, or influenced by, stormwater runoff from inland areas, but the depth of flooding generated by the tidal rise and fall of the Atlantic Ocean is greater than flooding from any fluvial sources. In some situations, depending upon the extent of the storm surge from a particular storm event, a flood hazard area may be tidal in the 100-year storm, but fluvial in more frequent storm events.
TIDAL FLOOD HAZARD AREA
A flood hazard area which may be influenced by stormwater runoff from inland areas but which is primarily caused by the Atlantic Ocean.
TIME OF CONCENTRATION
The time it takes for runoff to travel from the hydraulically most-distant point of the drainage area to the point of interest within a watershed.
TOTAL SUSPENDED SOLIDS
The insoluble solid matter suspended in water and stormwater that is separable by laboratory filtration in accordance with the procedure contained in the "Standard Methods for the Examination of Water and Wastewater," prepared and published jointly by the American Public Health Association, American Water Works Association and the Water Pollution Control Federation. The term "TSS" shall have the same meaning as "total suspended solids."

TRACT
An area of land composed of one or more lots adjacent to one another, having sufficient dimensions and area to make one parcel of land meeting the requirements of this ordinance for the use(s) intended. The original land area may be divided by one existing public street and still be considered one tract provided that a linear distance equal to more than 75% of the frontage of the side of the street having the larger street frontage lies opposite an equivalent linear distance of street frontage on the other side of the street.
TRAILER
A structure standing on wheels, towed or hauled by another vehicle, and used for short-term human occupancy or as a temporary office or for the transport of materials, goods, or objects.
UHAC
The Uniform Housing Affordability Controls set forth in N.J.A.C. 5:80-26 et seq.
UNSUITABLE SOIL
All soil other than suitable soil.
URBAN COORDINATING COUNCIL EMPOWERMENT NEIGHBORHOOD
A neighborhood given priority access to state resources through the New Jersey Redevelopment Authority.
URBAN ENTERPRISE ZONES
A zone designated by the New Jersey Enterprise Zone Authority pursuant to the New Jersey Urban Enterprise Zones Act, N.J.S.A. 52:27H-60 et seq.
URBAN REDEVELOPMENT AREA
Previously developed portions of areas:
 
1. Delineated on the State Plan Policy Map (SPPM) as the Metropolitan Planning Area (PA1), Designated Centers, Cores or Nodes;

2. Designated as CAFRA Centers, Cores or Nodes;

3. Designated as Urban Enterprise Zones; and

4. Designated as Urban Coordinating Council Empowerment Neighborhoods.
USDA SYSTEM OF CLASSIFICATION
The system of classifying soil texture used by the United States Department of Agriculture which defines 12 soil textural classes based upon the weight percentages of sand, silt and clay in that portion of the soil which passes through a sieve with two-millimeter openings. The soil textural classes are shown graphically on the USDA Soil Textural Triangle, as shown in Subsection K.3.a.
UTILITIES
Those services customarily rendered by corporations or the municipality, under the review of the Public Utilities Commission, for public service, such as electricity, gas, telephone, water and sewerage, including the appurtenances used in connection with the supplying of such services.
UTILITY DISTRIBUTION LINES
Lines, conduits or pipes located in a street, road, alley or easement through which natural gas, electricity, telephone, cable television, water, sewage or stormwater discharge is distributed to or from service lines extending from the main line to the distribution system of the building or premises served. Utility distribution lines do not include electric transmission lines.
VALUE
The relative lightness or intensity of a color, one of the three variables of soil color defined within the Munsell system of classification.
VARIANCE
A grant of relief by the Planning Board from the requirements of this section that permits construction in a manner that would otherwise be prohibited by this section.
VARIANCE
A departure from the terms of this ordinance authorized by the appropriate municipal agency in accordance with N.J.S.A. 40:55D-1 et seq.
VEGETATION
Any plant material including grasses, shrubs and trees.
VERY FIRM CONSISTENCE
Is characterized by a moist soil which crushes under strong pressure; barely crushable between thumb and forefinger.
VERY HARD CONSISTENCE
Is characterized by a dry soil which is resistant to pressure, can be broken in the hands only with difficulty; not breakable between the thumb and forefinger.
VERY-LOW-INCOME HOUSEHOLD
A household with a total gross annual household income equal to 30% or less of the median household income for the applicable housing region.
VERY-LOW-INCOME UNIT
A restricted unit that is affordable to a very-low-income household.
VETERAN'S PREFERENCE
A preference for low- and moderate-income housing that is permitted by law for people that have served in the military.
VFR RUNWAY, FIVE-THOUSAND-FOOT APPROACH SURFACE (MINIMUM STANDARD)
A runway approach/departure path that is 1524 meters (5000 feet) in length, 76 meters (250 feet) in width at the inner surface, and expands uniformly to 381 meters (1,250 feet) in width at the outer surface. It has a 20/1 upward slope from the ground from its inner surface and is free of penetrating obstacles. From its inner surface to 305 meters (1,000 feet) outward, the VFR approach surface and clear zone define the same area and are always so co-located (see definition of "Clear Zones" herein).
VIOLATION
The failure of a structure or other development to be fully compliant with this section. A new or substantially improved structure or other development without the elevation certificate, other certifications, or other evidence of compliance required in 44 CFR 60.3(b)(5), (c)(4), (c)(10), (e)(2), (e)(4), or (e)(5) is presumed to be in violation until such time as that documentation is provided.
WATER CONTROL STRUCTURE
A structure within, or adjacent to, a water, which intentionally or coincidentally alters the hydraulic capacity, the flood elevation resulting from the two-, ten-, or 100-year storm, flood hazard area limit, and/or floodway limit of the water. Examples of a water control structure may include a bridge, culvert, dam, embankment, ford (if above grade), retaining wall, and weir.
WATER TABLE
The upper surface of a zone of saturation.
WATERS OF THE STATE
The ocean and its estuaries, all springs, streams, wetlands, and bodies of surface water or groundwater, whether natural or artificial, within the boundaries of the State of New Jersey or subject to its jurisdiction.

WEATHERIZATION
Building insulation (for attic, exterior walls and crawl space), siding to improve energy efficiency, replacement storm windows, replacement storm doors, replacement windows and replacement doors, and is considered a major system for purposes of the rehabilitation program.
WELL
A bored, drilled or driven shaft, or a dug hole, which extends below the seasonally high water table and which has a depth which is greater than its largest surface dimension.
WET POND
A stormwater facility constructed through filling and/or excavation that provides both permanent and temporary storage of stormwater runoff. It has an outlet structure that creates a permanent pool and detains and attenuates runoff inflows and promotes the settling of pollutants. A stormwater retention basin can also be designed as a multi-stage facility that also provides extended detention for enhanced stormwater quality design storm treatment and runoff storage and attenuation for stormwater quantity management. The term "stormwater retention basin" shall have the same meaning as "wet pond."
WETLAND SOILS
Those soils designated as very poorly drained or poorly drained by the Soil Conservation Service of the United States Department of Agriculture including, but not limited to, Atsion, Bayboro, Berryland, Colemantown, Elkton, Keansbury, Leon, muck, Othello, Pocomoke, St. Johns and freshwater marsh and tidal marsh soil types.
WETLANDS
Those lands which are inundated or saturated by water at a magnitude, duration and frequency sufficient to support the growth of hydrophytes. Wetlands include lands with poorly drained or very poorly drained soils as designated by the National Cooperative Soils Survey of the Soil Conservation Service of the United States Department of Agriculture. Wetlands include coastal wetlands and inland wetlands, including submerged lands. The "New Jersey Pinelands Commission Manual for Identifying and Delineating Pinelands Area Wetlands: A Pinelands Supplement to the Federal Manual for Identifying and Delineating Jurisdictional Wetlands," dated January, 1991, as amended, may be utilized in delineating the extent of wetlands based on the definitions of "wetlands" and "wetlands soils" contained in this section, N.J.A.C. 7:50 2.11, 6.4 and 6.5. The term "wetland" shall have the same meaning as "wetlands."
WETLANDS MANAGEMENT
The establishment of a characteristic wetland or the removal of exotic species or phragmites from a wetland in accordance with the standards of N.J.A.C. 7:50-6.10. For purposes of this definition, exotic species are those that are not indigenous to North America.
WETLANDS or WETLAND
An area that is inundated or saturated by surface water or groundwater at a frequency and duration sufficient to support, and that under normal circumstances does support, a prevalence of vegetation typically adapted for life in saturated soil conditions, commonly known as "hydrophytic vegetation."
WETLANDS, FRESHWATER
An area that is inundated or saturated by surface water or groundwater at a frequency and duration sufficient to support, and that under normal circumstances does support, a prevalence of vegetation typically adapted for life in saturated soil conditions, commonly known as hydrophytic vegetation; provided, however, that in designating a wetland, the three-parameter approach (that is, hydrology, soils and vegetation) enumerated in the April 1, 1987 interim-final draft "Wetland Identification and Delineation Manual" developed by the United States Environmental Protection Agency, and any subsequent amendments thereto, shall be used.
YARD, FRONT
An open space extending across the full width of the lot and lying between the street line and the closest point of any building on the lot.
YARD, REAR
An open space extending across the full width of the lot and lying between the rear lot line and the closest point of the principal building on the lot. The depth of the rear yard shall be measured horizontally and at right angles to either a straight rear lot line or the tangent of curved rear lot lines.
YARD, SIDE
An open space extending from the front yard to the rear yard and lying between each side lot line and the closest point of the principal building on the lot. The width of the required side yard shall be measured horizontally and at right angles to either a straight line or the tangent lines of curved side lot lines.
 
ZONE OF SATURATION
A layer within or below the soil profile which is saturated with groundwater either seasonally or throughout the year. This includes both regional and perched zones.
ZONING PERMIT
A document signed by the Zoning Officer which: A. Is required as a condition prior to the use or the construction, reconstruction, alteration, or installation of a structure or building, and in accordance with Township Zoning Permit Ordinance § 1000; and B. States that such use, structure or building complies with the provisions of the Municipal Zoning Ordinance or variance granted by Medford Township.

Word Usage.
For the purpose of this section, certain phrases and words are herein defined as follows:
A. Words used in the present tense include the future;
B. Words used in the singular number include the plural number and vice versa;
C. Words used to include the male gender include the female gender and vice versa;
D. The word "used" shall include arranged, designed, constructed, altered, converted, rented, leased or intended to be used;
E. The word "lot" includes the words "plot" and "premises";
F. The word "building" includes the words "structure," "dwelling" or "residence";
G. The word "shall" is mandatory and not discretionary; and
H. The word "may" is discretionary and not mandatory.

Any word or term not defined or referenced herein in § 202: Compliance with Other Definitions. of this ordinance hereinbelow shall be used with a meaning of standard usage as defined in Webster's New International Dictionary of the English Language, unabridged and latest edition.

Whenever a term is used in this ordinance which is not defined in this ordinance nor in the Pinelands Comprehensive Management Plan (N.J.S.A. 13-18A-I et seq.) but which term is defined in the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.), such term is intended to have the meaning as defined in the Municipal Land Use Law.

Whenever a term is used in this ordinance which is not defined in the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.), but which term is defined in the Pinelands Comprehensive Management Plan (N.J.S.A. 13-18A-1 et seq.), and/or in this ordinance, such term is intended to have the meaning as defined in the Pinelands Comprehensive Management Plan and/or this ordinance.
